Well you can't blame a company for taking actions that will result in their financial favor as long as it's legal. If there is something wrong in this picture, it is the system, not Apple.

Agreed.. Legally they are in the right, even if it makes some people who are interested in a product mad. Apple has every right to protect their property.. However if it is found that their patents are not being infringed upon... There should be a legal venue for Samsung to get paid for the un-validiated delay in their business. That, however, would be a fair balancer.

I predicted this. Actually, anyone can, really.

The matter is simple; doesn't matter how much we dislike Apple, they have a precedent (and a major one!) under their belt in Europe. I've never seen a winning party in a fight willingly give up the fight after offers of "truce" from the losing side. No fight ever works that way, and this is the same.

Meanwhile, there must be a whole lot of cussing going on at Samsung HQ about now.

In war that can be a downfall though.. If there tables ever turn the "losing party" becomes the "We will make heads roll for what you did to us". As they say in old roman words.. "If your going to kill a mans father you best kill his son as well". Or in Apple's predicament if you won the first fight but fail to win this one and they win instead. They will start slashing harder and harder at apple's guts and won't let up period..

They have no precedent in Europe. They are 50/50. They won based on the 2004 CD in Germany, but lost based on the same CD in the Netherlands. Samsung is currently trying to get the CD invalidated. If they were to fail, then that would be a precedent. If the succeed, then Apple are 0/2 in Europe.

Case in Australia is now down to only 2 patents. If Samsung can convince the court that there is prior art in Synaptics touchscreen tech or that Samsung's manufacturing process is different enough, then that takes care of the 1st patent.

2nd patent comes mostly down to how broad it is. If the patent on heuristic multi-touch rejection is deemed broad then it is invalid based on prior art. If it is more specific, then it is valid, but also fairly trivial to work around.

I don't see Apple's position as being particularly strong. At their peak they were alleging that Samsung were infringing on 13 of their patents. They are now down to only 2. Guess the Tab wasn't such a slavish copy after all. Of course Samsung had to remove features, but since there was no deal the case is still ongoing, so that means Samsung will still be trying to get all the matching patents invalidated.

Competition from other tablet manufacturers is also increasing, so either way Apple is likely to lose market share.

If a statement such as that doesn't show just how arrogant, obnoxious, and underhanded Apple is as a whole, then I don't know what will. He basically said Apple is out to prevent competitive products from even launching in order to maintain its own market dominance. Paranoid much, Apple? It's as big a self-incriminating statement as I've ever seen.

I can remember when Apple was crying to Gates and he had to bail them out. Man what pr*cks to stifle innovation on all fronts. The patent system needs reform, but after the stink that socialised medicine is causing in the US it's going to be like pulling teeth (pun intended)

Well, apple is nto so famous outside of the USA anyway.
That is the problem.
Most ppl in USA buy stuff becouse in USA "you buy stuff". So if there is this new Apple iPad, you buy it.
In the rest of the world, ppl normally dont buy new gadgets that they dont need for a long time. In this case, getting a delay in australia and everywhere else till christmas, will mean that the % of ipads that friends show to other friends will be big enought , that eventually it will take over.
However, if you have galaxy and ipad, then ppl will compare both, and then if i got an ipad, and it turns out to be worse, i will get angry at apple (becouse i wont at myself , right?), and put that on forums, etc.

Its a siple marketing trick, nothing more. And Apple, Samsung and the court know all this, but they follow "A Law" that is basicly possible to abuse.

Surely the Mark of a good product is it's ability to compete against it's competitors, Apple should have faith it's it's own product for it to be able to stand successfully against the Market. In saying that, like or dislike apple they are an innovative company and they are the fore runners in the mobile phone and originators of the tablet. Like any savvy business or company you want to protect your investment that after all is the maelstrom of the patent and copyrighting legislation. If that was you or me and we stood to loose money from someone stealing our work/idea wouldn't we do exactly the same ??

It's not about faith. Apple is trying hard to protect its own IP. Whereas idiots from M$ milking from open-source Android phones! There is a huge difference between those two companies.

Next, I don't believe these Chinese/Korean companies so easily because they want steal a big slice of pie with their well known design tactics. I'm not saying Apple is 100% truthful company but you see when it comes to the United States technology stealing this I can't accept. Why these fcukers from Samsung develop their own designs? I saw Galaxy very closely, even a child could say they copied it from Apple's iPad. Isn't this true?

Plus, most annoying is you try to back stab your biggest customer (Apple)! It all looks like Apple has met a good Hardware challenge in form of Samsung compared to its Software challenge from Microsoft from decades. Whether you guys admit or not, Apple is doing very good when it comes to Technology, Innovation, Business, Marketing, Jobs, and most importantly Software and Customer Satisfaction. So whiners can always cry about Apple's success & leadership.

Note: I'm no Apple fanboy but I use a lot of their products. So, don't ever try to tag such things over me. Thank you.
