Inspiron 15r 5520 touchpad scroll not responsive

My new Inspiron 15R 5520 has a problem with the touchpad. The scroll only works when it wants to. It's like I loose control of the screen or something. Even if I have control it doean't respond. It's becoming a pain. Any suggestions?

I have updated my drivers. I don't believe this to be a hardware issue either. I can be typing away and the screen looses focus. Or doing nothing at all and the screen will loose focus. I turn around and look bac thenwant to scroll and the red X at the top is now gray. I have to click on the screen to gain focus again before scrolling.

It seems there is something running in the background that is taking over the computer and focus away from the screen.

I'm still looking so any help you can provide is greatly appreciated.
