Nasty break-up ...getting out of phone plan

my daughter's boyfriend shut off her phone after a nasty break-up. The company had offered a deal of buy one, get one free (phone). The plan is in his name. She claims she has to pay about $500 to be able to keep her phone. I said, it's HIS problem. She should be able to get the data off her phone, and go somewhere else, right?

If the phone is in his account, that might mean he can disable it.
She should get her own phone and plan.

If the phone was setup under his account, it's his phone and he let her use it. To get the phone unlocked you need to contact the service provider. The phone should be returned or be paid for. There is no issues at all with getting her data off the phone, just back it up somewhere.
