So if I RECEIVE a nude pic of 16yr old (regardless of sex), and accidently view it, I'm going to jail -- and not the sender?

Why would people you converse with send you child porn? I highly doubt if you received it you would be going to jail either, they probably want to get rid of it or charge anyone who forwarded the picture. They are all kids though, but I am sure they girl is having some trouble with the pictures being spread around school. Must be a terrible feeling for her, lesson learned.

if she didnt want people to see it she shouldnt have taken it in the first place. Or perhaps sent it to anyone so it could be spread.

Either change the laws as they are, or THROW THE BOOK AT THE GIRL WHO SENT THE PICTURES... and to any of the guys who forwarded them. The guys who received the images but didn't forward them... they're just unwilling recipients and shouldn't count for anything in the eyes of the law.

It is like anything else. If you receive something you know is illegal (pics, DVD Player, car, insider trading information) and you do not report it... then get caught with it, then you go to jail. Works the same as other laws.

Another example... let's say a pound of coke gets accidently delivered to your door via Fedex. If you report it, you don't have any issues with the cops. They will not arrest you. They will just take the coke. If you don't report it... keep it in your house and then get busted with it, that is entirely another matter.

So let me get this straight: sex offenders (rapists, pedophiles, peeping-toms, etc.) are slapped on the wrist and are roaming our communities, but an innocent text message which is deemed "sexual" in nature can fuck my life over even if that text/picture was unsolicited? Yeah, got to love the way life works...

Is it still the case in the UK that you are guilty until proven innocent? If that is the case, there is more to fix than just this item. After reading the article, I am left with the feeling that there is a lot more to what happened than is in this particular article.

Kid's are going to be kids. We were just sneakier about it when WE were kids... you know? I understand the whole "child porn" issue, but if you throw e\/ery kid in ju\/ie that does this then we will ha\/e a whole slew of criminalized children, for doing things that their hormones tell them to do. Not to mention the fact that people under the age of 18 ha\/e sex all the time, is that considered child molestation? These things happen, Get the crap under control, delete it and ha\/e their parents kill their cell phone's for a month. Parenting can go a way in helping stopping this kind of thing from happening. EG: no camera phones. Keystroke loggers, etc.

Why is it illegal for kids to look at naked pictures of people their own age? A 16 year old looking at naked pictures of 16 year olds isn't looking at someone creepily younger than him, he is looking at someone their own age. Doesn't make sense to me.

But what this really comes down to is the stupidity of the girl that sent the original text message, and then authorities attempting to blame everyone else but the stupid one.

You should study law a little bit before you make a silly comparison such as that stupid "pound of coke" nonsense. I won't even explain why.

Originally, the taking, possession or distribution of pornography involving a minor was considered an instant crime. Only recently, because of cell phone tech, has the issue been raised regarding minors sending pictures of themselves. In the application of existing laws, public opinion has made its case and most of these cases do not result in prosecution. The laws evolve to match the public's desire. This is pretty much the way it has been the US for most of its history.

OMG people are just fucking dumb. No one remembers what it was like being a teen I guess, hormones raging, logic receding (for those that exercise logic) lack of sleep oh yeah and lets not forget sexual frustration like you never feel again. People just want the kids to be precious innocent little angels till they turn 18 and they magically become adults with all the rights therein. Well we all do not mature at the same rates, children now days are maturing faster than any youths ever in history, but we will not recognize that, they must remain pure and sexless till they are full fledged adults of 35.

This attitude of purism in teens is why the teen pregnancy and teen aids rates are so high, instead of teaching sexual safety the schools teach that condoms are like Russian roulette and abstinence is the only way to protect yourself. Instead of enacting a real world approach we opt for fantastical ineffective methods like abstinence or religion, and we call the teens immature.

If you do not want your precious perfect little angelic creature to become a kiddie porn star do not buy them a phone with a camcorder in it, again this comes down to dumb-assed moronic parents.

The kids are paying for the phones and the plans by themselves right? Wrong the parents should be in jail for inducing child pornography and inducing its distribution if it is classified as pornography. Make an example out of these moronic parents and watch the cameras get disabled one by one.

WTF are teens doing with cell phones in the first place? Emergencies that is the typical excuse, you know how to make a call in an emergency-Collect at a payphone. Works for my kids, worked for me, worked for my parents, worked for their parents, and their parents had the telegraph and smoke signals, none of which INDUCE Child Pornography or its distribution.

Last time I checked nudes of kids are not illegal the pose and situation they are in at the time of the photograph is the determining factor to whether it is classified as porn or not.

A quick search on google, bing, or yahoo for nudism will turn legal nudes of minors, they are not legal because they are not sexual, just being nude does not make for sex.

If the girl in question was in a sexual pose centering on the genitals then it is porn and should be punished, but I'd be willing to wager that she was in front of a mirror just naked, I would further speculate that the girl took the photo by herself making it a self-portrait, she was not coerced or forced. Her first dumb move was sending to someone, not keeping it on her phone in her control.

Americans Students, American Politicians, American parents are not as bright as you might think. Ill has a 17 Year Age of Consent, being 16 she will be classified as a child, unless you feel life begins at conception she might have her age adjusted by 9 months and be considered an adult, but that is wishful thinking. Why is it that when a child acts like an adult, murder for example, they are punished as an adult, but when they display other adult behaviors like this one they are not even given the benefit of the doubt the murderer gets?

If the charges stick the lives of all the minors involved will forever be ruined all will have to register as sexual offenders despite they fact they are all probably virgins, they will forever be grouped with the pedophiles, rapists, molester and child murderers.

Let the punishment fit the crime.
