I would think if this is a significant issue and Intel isn't replacing the mobos for free there would be a loud outpouring of complaints online in addition to class action lawsuits. Unfortunately with class action lawsuits, the lawyers get rich and the damaged consumer gets a $5. coupon worth the purchase of a product from the manufacturer who sold the original defective item. So the consumer is the only one who actually loses...

If the Nvidia class action lawsuit showed, most people got a very low-end CQ56 laptop to replace their HP laptop. It was a single core processor, without even a Expresscard slot and 2 GBs of memory. The replacement was inferior to most of the machines that were replaced. The machines took more than six months after the settlement. It was only worth it if you had a very low end machine to begin with.
