That is seriously your argument? If someone is selling a product, I have a right to purchase it. Due to the fact that I am giving them money for their product, that means that I own that product that at time. Since I own the product(not the copyright for the product, just the item I purchased), I can do whatever I wish with the product.

OK, it's not suggesting that jailbreaking a phone will crash the tower, it's trying to suggest that a person who jailbreaks a phone may also decide to intentionally crash a tower with their jailbroken phone... There's a fully open source mobile phone , the Neo FreeRunner ( Open Moko Project ) and I don't see that being used to hack into GSM networks.
Heck I even saw a guy working on open source code for the baseband CPU of a Motorola phone.
The only problem with jailbraking is that it's costing Apple money. Other then that it's not really hurting anyone other than Apple's pockets.
