Apple Sues Amazon for Use of 'App Store'

I wonder if Apple can legally do anything to Amazon for using it even if they did put 'App Store'. It says Apple has FILED for the patent, not that they own it. It hasn't been approved yet so there has been no patent infringement. My understanding of patents (and it could be wrong), but you can file for a patent and before it is approved another company could file for the same patent and there would be a whole process that would have to be followed to decide who gets the patent. I don't believe the patent is automatically awarded to the first person to file. Wouldn't that be interesting of Amazon were to counter-file for the patent?
 
Its almost priceless from a company that took its name from a record company
iPhone from Cisco/Linksys
iPad from Fugitsu

Ohh and even patented the wiimote(or was it magic wand) even after Nintendo did.

people just love to bend over for a free ipod or macbook.
 
How can this work? They are trying to trademark the term "App Store" which means ONLY "App Store" Amazon store name is "Amazon Appstore" they can't sure over that, Amazon is not using their trademarked term (which they should not be granted in the first place).
 
TRADEMARK!!!! they filed for the trademark not patent, you cant patent a name......... well when i last check you couldn't, i could be wrong

so question is how on earth does apple think this is going fly, cause a dude looking to download an apps for his iSomething is going mistakenly buy an android apps.........
 
Thats pathetic that they are going through all this trouble for a generic name like that. Apple, grow up. You don't own everything. Spend your time fixing the dam MBP's.
 
Don't forget this is the same Apple that sue the city of New York for using a picture of an Apple in it's "Big Apple" poster campaign.

This is the same Apple that stole the Apple logo from the Beatles and pissed all over the legal agreement not to enter the music business.

They couldn't care less if the name is generic or not, if fact if Apple could get away with trademarking the word "Generic" so they could sue anyone who makes cheap non-brand goods they would.

Steve Jobs would boil his Granny if you told him it would make money.

The legal firm of Dewey, Screwum, and Howe has announced the formation of a class action lawsuit on behalf of apples everywhere. As actual apples existed before Apple, and have as yet received no remuneration for the continued misuse of their name, Gala, McIntosh, Fuji, and Red Delicious apples are suing for both real and punitive damages, as well as licensing fees. "Apple has misappropriated our name, and used it in ways that besmirch our integrity as fruit. This travesty must end!" No word yet on whether Pink Ladies or Granny Smith will join as parties in the suit, and calls to Golden Delicious and Cameo have not been returned at press time
 
i think since all of us users coined the phrase application or app. we should band together and sue the piss and vinegar right out of apple for so much they shrivel up and wither.

Actually, I recall them suing a Canadian company that used an Apple in their logo - I think they were an educational software company. Y'know, someone who would have no reason to use an apple in their icon as it has no association with education. If there had only been some sort of saying that related education with apples...

No, actually I think that Apple might start suing religious organizations - for we all know the great Creator Steve Jobs made the Apple. 😉

Cool, now Microsoft can go after you for bringing up one of their bigger flops and reminding the public about it. ME. *shudders*
 
Oh, how I would like for someone to step in and stop all this patent trolling. I think we need to start thinking in reverse, and create a list of general terms and tech that can't be patented. Next thing you know someone can patent 0²!
 
What's so special about the words "App Store" anyway? One of the following will probably fit with someone's Branding.....

I thought Apple only trademarks coined works that start with 'i'.... App Store does not behin with 'i'. iPhone, iPod, iCal, iPhoto, iSuck, iPorn etc its not like its iApp Store, so what the big deal?

Oh by the way, the name iPhone was owned by another voip company, before apple stole it. So apple is a rip off artist too.
