Question Bought from Ebay, unsold carrier questions

Hi,
I just bought a Sony Xperia XZ2 compact from Ebay, the phone was advrtised as new.
Upon receiving it, i noticed no sticker seal, phone plastic warp being not folded the correct way and IMEI number telling me "1 year 3 months and 9 days, with warranty expired with some january date".

Ive putted a bad review on sellor saying its refurbished, which he replied "sorry to hear ect... we get phones from unsold carrier to drive down the price".

Is it actualy new or refurbished?
The battery doesnt seem to have any issue.

Hey rgd1101, im having hard time finding compact phones to ticks all my boxes, i was thinking keeping it, why do you advice to return it?
Is it refurbished or something else im not aware of?
