CyberpowerPC laptop locked at 40fps?

So about 3 months ago i bought a gaming laptop for a close family member so we can play video games. I Specifically bought the Vector II-Z 15 VR 500 Gaming Laptop which consisted of:

CPU: Intel® Core™ Processor i7-7700HQ 2.8GHz Turbo 3.8GHz 6MB Cache Processor (KabyLake)
HD_M2SSD: 250GB WD Blue M.2 SATA-III 6.0Gb/s SSD - 540MB/s Read and 465MB/s Write (Single Drive)
HDD: 1 TB 7200RPM SATA300 Hard Drive [+65]
MEMORY: 16GB (8GBx2) DDR4/2133MHz SODIMM Memory (Performance Memory by Major Brands)
MOTHERBOARD: Intel® HM175 Express Chipset
NETWORK: Gigabit LAN 10/100/1000
NOTEBOOK: 15.6" FHD IPS (1920 x 1080) Anti-Glare Displays LCD w/ RGB Gaming Keyboard, HDMI 1.4 & mini Display Port
NOTEBOOK_COVER: VECTOR II-Z 15 Cover
OS: Windows 10 Home (64-bit Edition)

I never used it until i visited his house, and i noticed that all games were running at a locked 40fps even though the screen was running in 60hz. Most games would start at 60fps in the title screen, but after a couple seconds it would dip down to 40. I turned v-sync on/off, and still received 40fps when the laptop was plugged in, and running on battery. Could it be a driver issue? the gtx 1070 is the only component i know is constantly updated but i'm not too sure about the other ones. I also made sure the power plan was running on gaming through windows and CyberpowerPC's control center program it came with on a Driver CD. I should also note there is a fps difference when plugged in, and when it runs on battery power. usually when its not plugged through the battery adapter the fps cuts in half, so it stays around 20-30fps.
