this IS nintendo blanketing all of europe because a law may apply to it, but has yet to EVER apply to it to my knowledge.

Germany, not eu
nintendo over there is based in germany, an they are applying a law to all of europe that doesnt even have a president set in germany as ever being used.
 
This is most definitely Nintendo's fault. All they need to do is to do the usual age verification (possibly asking for a credit card) and that should be enough. If it isn't enough, then prepare for every single other content distributor in Germany to start facing hefty fines because none of them do this. Also, what 16 year old isn't up past 11pm anyway?

Let me tell you that there's no law in Germany which restricts consuming adult content to 11pm-3am in general. However, this may apply if one is not willing to implement parental control mechanisms. So who's really to blame?

... the death of something that should never have happened and will be undone sooner or later does not greatly worry me.
