If the photos are on a different device, the only way to get them off that device is if the device is working. If it isn't it would have to be repaired.

If it is working, then you can upload the files to a google account and then download them to the new device,you can email them to yourself, (in both cases as long as the old phone has access to Data or WiFi). Or you can connect the old phone to a computer, via USB cord, and move the files to an empty folder on the computer. Then remove that phone and connect the new phone to the computer. From there you just copy or move the files to the new phone.
