Then you're a pussy. Why does everything these days have to be disturbing or offensive. Just delete the damn pic and be on your way like a normal person rather than a kneejerk crybaby who is constantly looking for stuff to get upset about.

Me neither, it's absolutely preposterous. So they do the right thing and get the console confiscated ? Imagine it was your PC, with all your private data on it ? Would they at least let you back it up so you can work on another PC ? What if you don't have another PC ? And anyway, why are they entitled to have your Console/PC with all your data inside ? Are you allowed to delete everything from it that has nothing to do with the case ?

I mean, if someone wants to upset you, they could mail you some strange e-mail like this one from a Wi-fi spot, sitting inside the car outside, and if everytime you get to do the right thing you also get to have your Console/PC confiscated ?

What if it was a one time thing ? What if the couple thought the sender had a virus that had sent the pictures ? Are you going to bother with all the SPAM you get ?

I mean, I could denounce to authorities everytime I'm told I won the Lottery in Zimbabwe, or everytime someone tells me I'm their favoured one to get all the money from a rich man that just died with no relatives.

What I'm saying is, there has to be a line drawn somewhere. In the caseof child pornography, I agree it's more serious, but still, the person who does the right thing should not be penalised for it, nor should the person who immediately deleted the message because of feeling morally offended by it, which in any case, is a perfectly normal reaction. I mean if the person had actually solicited the message, that's entirely different, but it's not the case.

Unfortunately the cops are right (even here in the US). Becaused they opened the e-mail and saw the pics, if the couple would have deleted it and police found out, there's a chance they could be prosecuted. Is it stupid, 110% yes. Did it happen, yes it has. To the police, this is aiding a crime because you didn't report it. Ain't the law grand..../sarcasm

Why couldn't the police just contacted microsoft and have them tell which account and which ip the porn originated from?

thats why the whole child porn crap is so much of a problem now. remember the police cant stop a crime if no one reports it (police cant be everywhere at once. people are less likely to report a crime that will put them in trouble especially if theres no guarantee that they will even catch the criminal.

like in this article, the criminal is probably still using their xbox 360 while the family that felt that they were doing the right think by reporting are now sitting at home, bored with out their xbox 360.

this causes crime rates to increase

for example look at neighborhoods that are considered to be "ghetto" or "the hood". theres generally a high crime rate and when ever the police investigate, no one ever sees anything. this creates a safe haven for criminals and thus, the crime rate increases. Then when a major crime happens, the people there go crazy and start complaining and causing a huge uproar about the police not doing enough to protect them. there is a reason why the phone number "911" was created it is so when a crime happens, it can be reported and investigated and witnesses and any one else who has information, will share the information and the criminal will be caught, but instead, everyone minds their business and no one sees anything.
 
The gardaí confiscated the console and told the woman that she and her partner were right not to delete the images because if they had, and they had been found on Microsoft's mainframe, they could have been arrested for possession of child pornography.

Am I the only person who has a problem with the above statement? So someone sends me some sick pictures and I immediately delete them, now Im on the hook for "possessing" child pornography if they find them somewhere on the MS mainframe? How is that justice?
 
I don't know about the law there but there are several issues with this in the US. Firstly, a photo of a merely naked child is not immediately considered child pornography. It's the depiction of the naked child in the photo that determines how it is classified. Was these children in the tub and this was an innocent "oh look bobby has bubbles on his head" type of photo that parents take? Was it an images of children that may contain some value as art or literary? National Geographic has many images of nude humans and never is a single image considered pornographic. The fact this it's a child doesn't change the depiction merely because of age. The article doesn't say. In the US it typically is lewd and lascivious depictions that classify an image as pornography. Let's not forget the acceptable practice of nudism. Cops are busting nudist colonies. People come together and live in entire communities where clothing is optional. Adults and children alike are running around naked. And yes, they take photos too just like clothed people. Guess what.. Naked children in those photos are not considered pornography.

This is directly from the national center for missing and exploited children website on "What is child pornography":

# depicts a minor engaging in sexually explicit conduct and is obscene, or

# depicts an image that is, or appears to be, of a minor engaging in graphic bestiality, sadistic or masochistic abuse, or sexual intercourse, including genital-genital, oral-genital, anal-genital, or oral-anal, whether between persons of the same or opposite sex and such depiction lacks serious literary, artistic, political, or scientific value.

I am certainly not a defender of someone who engages in true child pornography but if the images are not TRULY pornographic and the law is confiscating xbox's and investigating senders then where does it start. Next a child in their underwear is suddenly grossly offensive to become pornography? Then what? A swimsuit?

If this is a true case of child exploitation, then they should really try and bust those who committed this act. Doing whatever is necessary and of course legal to accomplish the goal. BUT, simply being offended by a nude photo of a child does not constitute pornography.

I wish that articles like this would come out and say "there was a clear violation of the law" rather than vaguely describing something leaving it open to interpretation.

I'm not sure about in the US, but here in Canada we don't have these 'good samaritan' laws. If I see a crime happening, I can ignore it and go on my way. Imagine if cops actually tried to enforce this. Jaywalking and littering anyone? Even if it only applied to serious crimes, you'd have to report any incident of violence (bar fights anyone?), including verbal assault and threats. I work downtown in my city, from my work window I can hear crackheads and homeless people yell obscenities/threats at each other at least a few times a day.

Australia has a new law. Nude or porn of small A-cup or flat chested adult women doesn't matter if shes 18, 25, 32, etc... is illegal and considered child-porn.

In the USA, there are now several cases and more coming in which kids are being charged as pedophiles. Why? Because some silly teen girl, around 13~16 takes nude and/or sexual photos and/or videos of her self with a web cam/ cel-phone, sends a copy to her boy-friend who may (in some cases) sends it to his friends cel-phones. One of the recent stories (I think posted here) - the girl is charged for distributing the child-porn as is the other dozen or so boys... even if they received the files without knowing what they were. W T F ?!

They are kids / not an adult, they do stupid things. Wrong yes. Tell them its wrong and why they shouldn't do it. Don't throw them in jail and ruin their lives.

Shes, even a friend of mine (She's 22) was contacted by MySpace by a local girl who is 16. Wants to hang out - who knows what. I told the friend, not worth it. Talk to her on MySpace is fine... if the wants to hang with you and be your friend, tell her she needs to wait 1.5 more years. By chance the girl called and the friend did tell her. Nothing mean, just don't want anything to be blamed or accused of. I explained and reminded her... its a kid who wants to be cool and hang around adults.

The Xbox situation is scary. If reporting gets you in trouble... uh oh, and if not reporting gets you in trouble... geez, guys - make up your mind!
 
LOL @ 16 and being friends. In the US that's such a gray area because consent laws are not national in all cases. For instance, it's illegal for anyone under 18 to appear in film, video, photos etc in a way that constitutes pornography and that law is nationwide BUT it's not illegal for them to actually have sex as long as they don't "document" it.

Further convolution is that some states have lesser laws on consent and some have levels. For instance, some states have an under 18 law. If the other person is under 18 and you are not... It's illegal to have any sexual contact. Other states, that law is age 16, some even 14.

Going even crazier, some states have limits to the law. I know that in North Carolina the law is 3 years under 14 and 4 years under 16. So you can be 12 and have legal sex with a 15 year old but not a 16 year old. And you can be 15 and have legal sex with a 19 year old but not a 20 year old. If you're 16 and above you can have sex with anyone aged 14 to 110... No law prohibits it.

Seems like we could just figure out ONE WAY to do things... but nooooooo.

Back on topic, yes it is a pain in the USA to be a good Samaritan. If you witness a crime you are legally obligated to report it. Even if you leave the scene of a car accident that you witnessed, you could be charged. Heavier crimes are worse. Not reporting child exploitation for instance makes you a party to the crime.

I personally know of a woman who had a young daughter. Her boyfriend molested the child and when she found out about it, she kicked him out and never ever had any contact with him again. In my opinion she should have called the cops and followed that route, but she did not do it that way out of fear of the ex-bf. She confided the abuse in a female friend who then reported it to the cops. The cops then charged the mother with a felony abuse charge and the friend was told that had she not reported it either, she could have been charged as well.

Not condoning the actions, but it does get ridiculous at some point on who has actually committed a crime. The mother should have done the right thing... but the friend "could have" been charged for not reporting a second hand account? Crazy.
