games and work, need bluetooth and webcam will be great

I would not get a laptop off ebay, your best bet is craigslist or a smaller PC shop where you can test the system. There are plenty of good sellers on ebay, especially the larger stores, but there are also many that sell faulty items that crash often or were broken and fixed instead of just used.

For $300 you can get a nice solid laptop that can handle Diablo, something like a Core i5 CPU, the integrated graphics can handle Diablo III OK. Some business models like the Lenovo T410 and 420 also come with nVidia Quadro graphics that are ok for Diablo III. Just look for decent prices, they are $1,000 laptops when new but used should be around $300. The T410 I had on ebay this week sold for $180 so you can get some good solid laptops...

Just make sure you run Prime95 and a video benchmark on the system to make sure it is stable.
