Absolutely. They would never have got away with it otherwise- way too dangerous!

definitely a key innovation AND a platform on which build the future of your software career, unlike the old boring Win32 that does boring things like to allow well written software to run reliably on systems released 20 years after they were compiled.
... my live tiles have never caused any of the walls in my house to fall down.
Should I sue for false advertising? Or should I wait for something to break in my home and then sue for having 'overly active live tiles' breaking my stuff?

I believe it's called advertising. It's part of the 1.5 billion dollars Microsoft plans on spending to promote Windows 8.
Marketers can use advertising to promote their products, or they can use promotional stunts to promote them... either way, most of the time, it's all bull$hit.
Trying to pass off an advertisement as a promotional stunt (which this is) is basically trying to hide bull$hit inside of bull$hit. It's the worst kind of marketing IMO.
