Not lucky so far, because all ideas, even those I have never heard about, are already patented or in production, and it is impossible to keep track of all tech of the world. But whenever I have had any idea, I have always so far let others use it, shown them, instructed them etc. be that idea as simple as a new way to stomp on the ground, that somebody in the other end of the world is using already.

and that would have been fine if not for the introduction of the "innovation" class of patents which basically allows you to patent an idea (no need to completely define the solution) have it preliminarily approved in a short period of time with little to no interrogation at all, once preliminary approval has been given you can go ahead and market/create a product with said idea, the patent can then be made legally acceptable at a later date via request for examination, which when approved applies retroactively and basically allows you to legally sue the pants of your competitors, im guessing this patent just past the examination stage

the majority of Apple patents unfortunately belong to this class of innovative patents
 
They did have this first, so it's only fair.

There are other methods, like touching the screen in different places, in different sequences, touch and shake (making use of the accelerators)...

On the other hand, I might just take inspiration from commenters at Tom's, and patent breathing or some way to "open" the girlfriend, and sue everybody for using it.

Oh come on.

Most of you people here need to grow up, get a decent education and get a job. Especially all of you haters, if you put half your hate energy into something productive then perhaps you could have accomplished something into actually changing the patent laws, or work for a company that worked with more open cards.

That said, I fully understand Apple. I don't agree with them a bit, but I do understand them. The current twisted and abused patent rules are fully open for abuse, and if Apple doesn't patent it someone else will, which will mean more problems and less money for Apple. It's very basic, it's either kill or be killed here.

I don't put any personal feelings into Apple or anyone else (Samsung, HTC, Microsoft to mention a few) doing the very same thing, but rather I loathe the current patent system as it is. The system forced the corps to do this, Apple (nor anyone else) doesn't do this just for funsies. It costs a lot of money and time to file and handle these patents and I bet they would think the money would be spent better elsewhere, but if they don't do it some REAL patent troll (like for example Lodsys that doesn't produce anything except lawsuits) will patent it and cause problems.

So all of you, grow up and get a pair and a brain and think for yourselves before you spew out nonsense hate and completely ineffective "I hate Apple i will never buy from them yada yada", because guess what? A few million of other people will anyway. Instead try to do something about it. Contact your gov representatives, gather a group, protest, whatever except sitting on your behinds and whine like 9 year olds.

I am myself trying to gather a lot of people here to try to work with our politicians to not get that patent junk into the EU. It may be a lost cause but at least I've tried. Can you say the same?

And ps, I do own both Samsung and Apple products. And I don't agree with either arguing about this and that patent, but from a business point of view I understand them. And they are in business to make money, they don't develop and give you stuff for free.

Wow, considering there were other phones that did this WAY before the iPhone.

Someone in the patent office screwed up royally on this one.

I use to like Apple, especially since that's what I learned to program on (Apple ][+ and //e), but this leaves a bad taste in my mouth, kinda of like a rotten Apple.

HP's now uncertain WebOS uses drag up to unlock. It is a small circle you have to move out of a half circle at the bottom of the screen. This should make them safe. I wonder if it could be considered an improvement and be patented as well as a multi-directional unlock system for touch screens 😛
