All I see here is a bunch of greedy lawyers trying to rip off somebody (HTC and Vivid). And since "vivid" is a standard word and HTC has nothing to do with porn I don't see how could HTC damage Vivid's interests.

Well: "Shoot a lawyer - save a child!"

Did Apple buy Vivid out and I didn't know about it? Cause clearly im going to think porn when I think of a cell phone what a fucking joke. the judge should fine Vivid for such a preposterous request

[citation][nom]g1zzer@hotmailcom[/nom]The HTC vivid will for ever more be called the "HTC porno"[/citation]
haha...HTC Porno kind of has ring to it! 😛

[citation][nom]ocelotty[/nom]I think that Vivid entertainment should stand up for themselves and show some spunk. Fortunately the HTC Vivid is not 3D enabled or we might really see a messy courtroom drama; Otherwise it could give whole new meaning to coming at you in 3D[/citation]

Doesn't Vivid already show lots of "spunk?"

vivid threatens to sue htc for using the name vivid.
meanwhile, apple threatens to sue every male/female hygiene product makers for using names similar to its flagship tablet.

[citation][nom]bunga28[/nom]No chance that it (vivid ent.) will win. zero, zip, dipadood, nope; no chance in hell or on earth. Vivid is an English word describing strong, clear impression or chroma. It's not ubiquitous. I think there a few similar cases that were thrown out by the judges. (I don't remember the specific, but I do know that they were thrown out.)[/citation]

Yeah, so is "windows". Check to see if that is patented. Dunno if you guys can remember another lawsuit, some time ago. A fresh start-up company set out to make their own version of Linux and made the mistake of naming it "Lindows".

Guess who got all hot and bothered and sued the heck outta them? Yupp, you guessed it. And they won too, so Lindows had to change their name to "Linspire". (http://www.linspire.com)

OK, perhaps this isn't the same situation and Vivid is definitely not Microsoft, but still, I think it qualifies as precedent. Which goes to show that given enough leverage, you can patent everything.

Windows and Lindows were the same type of product. Vivid to my knowledge is a movie studio, and isn't related to technology.

Can't patent a word you trademark it and Windows is only trademark in regards to Operating Systems. Microsoft cannot go out and sue a window making company (actual glass) for using the word, but they can sue an Operating System maker who names their OS Lindows, since that company is very much trying to get people to use it based on it's closeness to the word Windows and Microsofts popularity. These 2 situations are not the same at all.

Cum on guys ! (sorry couldn't resist the pun)

This is blatantly a publicity exercise by Vivid films !

I think the "HTC Pow Chikka Pow Wow" would be another good option.

Reminds me of how Edge Games started threatening anything in entertainment that used the word Edge in their names, even some movie by Fox called The Edge. Lots of folks just folded, but the ones that took it to court succeeded. They messed with EA over Mirror's Edge and did not know with who they were f-ing.
