Threatening Rap on YouTube Lands Two in Jail

9/11 was just used as an excuse...

Foley's mom chimed in to the whole ordeal, claiming that her son was no threat, and that he had hoped the video would catch the eye of a would-be producer.
The 9/11 excuse is just as bad as the mother's...wtf!
 
Then they mentioned the names of specific officers, showed footage of a gun, and peppered their rap with sounds of a firearm going off.

So not only did they mention actual names in there stupid little rap, but they actually produced some gun's too. Are you freedom of speech idiot's going to sit behind your monitors are try to defend these two moron's and say they have the right to do that freely? They have intent, shown they have a means, and made direct threats to specific individual's on a public forum. Your freedom of speech is protected, but if your a moron you still go to jail.
 
I agree it is pretty dumb to arrest them for that but are people seriously this dumb to constantly post stuff on youtube that has the possibility of getting them arrested? My favorite moment was when that group of girls posted a video of them kicking the crap out of the other girl and all of them (except the victim of course) got arrested. If people are seriously that dumb they should be removed from the gene pool, plain and simple. It's like someone saying "Hey I'm going to rob a bank and post the video online of me doing it so every one can see how bad ass I am!"
 
Words alone should never be criminally actionable in a free society. The one exception: shouting "Fire!" in a crowded theater, or its equivalent. This just shows how far down the road to a total police state we've been dragged since 9/11. I look forward to a cop shooting a handcuffed arrestee in the face on video while shouting "9/11!".
 
Well if that's how it goes they shuold go lock up those ass holes that publicly supported the Fort Hood shooter and were proud of his actions.
 
I can see both sides on this one.
On one hand you have the cops, I would be kinda worried too if some one made a video mentioned me by name and was waving around guns....

On the other hand the kids probably did not mean anything by it except to blow off some steam and make a rap video.

They say to make good music you should use personal experiences, I would say that in this case they should have left out the details if they had said officer or cop or even pig or some other knock on cops instead of specific names they would have probably been fine.
 
Has anyone even read the article? Why do people keep talking about them as being kid's, one was 24, the other was 28. Also, we are talking about someone who was threatening his probation officer, did you know that in order to get a probation officer you usually have to be a criminal? A criminal spouting off threats on youtube waving a gun is just a silly joke by a 28 year old kid yea.
 
azgard: I suppose that since all of our laws are just, that the probation officer is by default a good guy, and they both deserved their punishment.

We have one of the most corrupt congresses in the world(oops, NM, those were "campaign contributions", not bribes), can't do jack about that, but we can sure arrest a couple of black guys for making a music video. We can also tax people for global warming, even though Climategate(tm) just proved it's all a hoax...
 
Um.. azgard what is wrong with showing guns and playing the sound of them going off? Seriously you douche, every single action crime drama on prime time has guns going off. There are movies and books and all sorts of other media out there where a fictional character targets something in real life. This rap is no worse than the movie Air Force One (a movie about terrorists capturing US President OMGOMGOMG ARREST THEM ALL AND LOCK THEM AWAY).

Do you even know what a probation officer is, and what a probation officer does? Regardless if you do or not this is called assault whether you do it on the internet, a piece of paper, a telephone, or someones face it's illegal the medium is irrelevant. Here read this sure look's black to me. Oh and look at those charges on him assault and battery, do your research, stop spouting garbage and come back with something worth reading.

Finally someone caught on.

Felonious possession of fire arms, caught on tape. Then you have a statement, which the rap boils down too of threatening activity or hostile intent towards a particular group or individual. You go to jail.

You people who are sitting there defending these two idiots need to learn that INTENT, not their actions got them arrested besides the fact atleast one of the terds probably did something to violate their probation anyway. Like maybe holding a firearm.

Your comparing apples and oranges. I dont see the names of any police or probation officers in your quote.
 
In case some of you missed the past 10 years of Western civilization, "post-9/11" means "take no chances with threats" it does NOT mean "terrorism on 9/11" or any such relation as that would, by definition, not be "post". The relation to 9/11 is just that, this threat is being taken seriously whereas a decade ago internet ramblings of stupid thugs would probably go unnoticed.

Get a grip, threatening to kill someone is a crime no matter who you are or who you are threatening. Threatening officials is an especially stupid crime.

Lets send you to another country for awhile so you can get your bearings. The USA system is not perfect but its the best we've got in the world (and I am an immigrant and now USA citizen).
 
tell ya what, when police actually deserve respect, they'll get it. Until then, they are just like every other person out there. the difference is they are stealing from the poor and not doing it legally (hence why its called stealing). I recent got pulled over in a 25 and the officer said I was doing 44. I took it to court and of course the officer was lying and the ticket was dropped. (what a costly pain in the ass to prove a point).
 
Battery requires physical contact.
Assault requires an imminent (read: immediate) threat.
Look it up before grabbing your ankles for big brother.
They will walk, and probably get a record deal. Which means I am double pissed at cops: not only are they using 9/11 to stifle free speech but now some shitty suburban rap group is going to get airtime.

You clearly don't understand free speech. In North Korea speech (spanning all forms of media) is censored not free. Here (the US) you can make a video like this...just get in trouble for communicating threats. They mentioned names which become a legit threat.

Look, man up for the words you say. Free speech is great, but it's not a get out of jail free card. When did we become punks and can't stand behind what we do? Don't do the crime if you can't do the time...literally...
