If I were a lawyer in the case and AT&T actually won, I think I'd get right on my laptop or phone and start clicking away... when the judge gets pissed and asks me what I'm doing, I'd say "Oh, sorry, I'm looking for a new job and housing in Canada... who want's to live in a country when big business can do whatever they want and the customer has no way to fight it? I'm outta here!"

oh yeah, one more thought - this actually sounds like a crappy, hard-to-believe it's real case that would be on that old show Boston Legal. Allan Shore would be fighting for the people while Denny Crane would be yelling at him that it's unpatriotic to fight big business and government. Man that show was good.

The judicial system needs a revamp. A telecom company can use a case that set a precedent 85 YEARS AGO!!! Yeah they had cell phone contracts in mind back then. I hope for everyone sake they don't win this.

Thats becasue ATT and the other cell companies know they are going to get sued for FORCING people with unlocked (not subsidized by cell company) phones into having a data plan. WTF is that? If they don't subsidise the phone who are they to force me into a data plan I don't want? Waiting for that law suit!

The problem with arbitrator's is that they are paid by the companies that employ their service.
This creates a automatic bias in favor towards the company that hired them. Remember these arbitrators are indeed just another company themselves Arbitration companies aren't seeking any form of justice for wrong doings naturally like any other company its about profits.
Then there is the problem of not being able to take it to courts even if you were blatantly screwed over through this process. While this may not seem to be devastating and indeed minimal if AT&T is allowed this on a individual scale when they wrong massive amounts of people and those people cannot form a class action lawsuit it adds up to so much more.
Then there are other companies that use this practice such as credit card companies
which can have a devastating effect on a individual who is in no way in the wrong.
I do not think this should be a forced act of signing your rights away to receive a service.
In fact no one should even be able to sign their rights away under any condition.
