If I were a lawyer in the case and AT&T actually won, I think I'd get right on my laptop or phone and start clicking away... when the judge gets pissed and asks me what I'm doing, I'd say "Oh, sorry, I'm looking for a new job and housing in Canada... who want's to live in a country when big business can do whatever they want and the customer has no way to fight it? I'm outta here!"

[citation][nom]lljones[/nom]You are not allowed to sue the government and they get away with murder. Hopefully AT&T looses this case. Class action lawsuits are the best defense the consumer has against Big Business.[/citation]

That reminds me of a while back where a government worker riding in a government car was drunk and killed a girl. And her parents couldn't do jack to that guy.

oh yeah, one more thought - this actually sounds like a crappy, hard-to-believe it's real case that would be on that old show Boston Legal. Allan Shore would be fighting for the people while Denny Crane would be yelling at him that it's unpatriotic to fight big business and government. Man that show was good.

[citation][nom]User69[/nom]Great those of you who voted for conservatives, reap your havoc, and thanks for being so stupid and pulling the rest of us down with you.[/citation]

LoL, you think this has to do with which side you're on? Doesn't matter which side you're on. Rep, Dem, they're just the "left" and "right" arms of the controlling body.

The judicial system needs a revamp. A telecom company can use a case that set a precedent 85 YEARS AGO!!! Yeah they had cell phone contracts in mind back then. I hope for everyone sake they don't win this.

[citation][nom]awood28211[/nom]I think the real problem is here that contracts should never be non-negotiable. This removes freedom of choice.[/citation]
Nope. You can negotiate. You say I WANT MORE MINUTES, they say NO. You say I WANT TO PAY LESS, they say NO. That's negotiating, and to make this short they just say no from the beginning.
They don't put a gun to your head. You can go to some other company. That's Freedom.

Thats becasue ATT and the other cell companies know they are going to get sued for FORCING people with unlocked (not subsidized by cell company) phones into having a data plan. WTF is that? If they don't subsidise the phone who are they to force me into a data plan I don't want? Waiting for that law suit!

There is WIFI everywhere I go. I don't need a data plan to cover the gap while I drive.

[citation][nom]fracture[/nom]LoL, you think this has to do with which side you're on? Doesn't matter which side you're on. Rep, Dem, they're just the "left" and "right" arms of the controlling body.[/citation]

Strangely enough, yeah. Its all about who's interests are important at the time. No one on both parties would take the "I won't take an industry job after my term" Pledge that some political group was asking senators.

Not one.

[citation][nom]therealfly[/nom]Thankfully, even if AT&T wins this case, there are no laws saying we have to buy a cell phone from AT&T.[/citation]

You're right.....but it would allow AT&T to refuse a customer's desire to "buy out" a contract without fear of legal action....

The problem with arbitrator's is that they are paid by the companies that employ their service.
This creates a automatic bias in favor towards the company that hired them. Remember these arbitrators are indeed just another company themselves Arbitration companies aren't seeking any form of justice for wrong doings naturally like any other company its about profits.

Then there is the problem of not being able to take it to courts even if you were blatantly screwed over through this process. While this may not seem to be devastating and indeed minimal if AT&T is allowed this on a individual scale when they wrong massive amounts of people and those people cannot form a class action lawsuit it adds up to so much more.
Then there are other companies that use this practice such as credit card companies
which can have a devastating effect on a individual who is in no way in the wrong.

I do not think this should be a forced act of signing your rights away to receive a service.
In fact no one should even be able to sign their rights away under any condition.

I had my bad dealings with att in 2000 when dsl first popped up(actually bellsouth at the time) 30 day money back guarantee my butt. Never again will I consider them for anything. I hate how contracts are so one sided!

So AT&T think they stand above the law and want to be able to do whatever they like against the "small people" without fear of having to take the consequences. How nice of them, i know i would vote with my green if i were a customer!

Just like 1and1.com
First they blackmail you with their domain registration scam, then they forbid you to participate in a -well overdue- classaction suit.
Let's hope the Supreme Court puts and end to this once and for all!!
