I wonder if the manufacturer of the camcorder will also face jail time. After all the camcorder did violate Italian law. The camera should never have allowed the user to record the bullying of the poor boy. This shows criminal intent of the manufacturer by deliberately omitting privacy safeguards.

I don't see where this is any different from the Pirate Bay indictment.
It was 4 Pirate Bay Execs that were charged for promoting the copyright infringement of others.
They did not appear in it, film it, upload it or review it, but still, they were on trial.
 
They did create the trackers that allowed people to use the torrents. I'm not entirely familiar with the specifics behind torrent tech, but this is much different.

I honestly can't decide if I'm surprised by any of this, though. More than anything, it just frustrates me that we have to live in a world where people with no common sense are in charge of people that do have common sense.

I'm going to buy a small island country and require intelligence tests before I let anyone in.
 
I side with Google on this one. That is stupid. They had nothing to do with it. Why convict them. This is as bad as a robber that gets hurt in your house and you get sued for it.
 
Unfortunately the Italian Prime Minister is constantly changing the law to his advantage, both to erase his criminal records and to improve commercial revenues. For a while now his party is constantly pushing Internet "regulations" (as in "censorship") that would put Italy to a position very similar to China.
This "decision" has nothing to do with the official fact but it is only one step to legalize control over video-sharing websites.
I know it might sound crazy but this is the Italian political situation at the moment.
 
i vote yes for a google pull out of any country that convicts them for being a provider of an awesome service.

have harsher punishments then community service for the real offenders who taped and uploaded the video.

I hope Google can find a way to get this totally ridiculous ruling overturned.

If not then perhaps they should ask the judge if he and 3 [there were initially 4 charged] other people of his choosing could review every single one of the massive amount of videos that get uploaded to Google.
Obviously they could not do this either (although they'd probably censor most of them like China does with any mention of Tienanmen Square etc but that's another story).

It's a good thing we don't have them Italian judges here in Australia on the appeal courts regarding iiNet vs (hollywood) AFACT [quite a surprise that a Judge/Justice actually knows what the internet is =) ].
