Laptop battery icon level stuck at 58%

Toshiba satellite L500 3 yr old battery suddenly started showing message 38% plugged in, not charging and despite working whilst plugged in via ac the level dropped to empty. I bought a new battery which when inserted showed 58%. I used the battery until the laptop shut down and the replugged in until the message said plugged in not charging but the % level throughout all this time stated 58%. I have followed the isntructions to uninstall the ACPI compliant control method battery already and scanned for hardware changes etc and no change. OS windows 7. Thank you if anyone can help me reset the battery icon so it works again.

hi again, I did a system restore to the date I inserted new battery and icon now working and showing correct levels.
