[citation][nom]beayn[/nom]irish_adam, you probably don't know, but you have been arguing with the great and noble Apple's most die-hard fan on the entire internet. Not only does he believe 100% of Apple advertising, he also thinks Apple is so undeniably awesome and so infallible that anything they make that has a problem is just a result of user error. That and their products are so utterly unique and so completely innovative that the problems will just go away through divine evolution. This is a company who in his eyes is divine and without fault. Nothing they do is ever wrong. Nothing they make is short of 150% the best. Nothing compares, nothing. And he *NEVER* makes mistakes. *cough*Oh, he also has never posted on a non-apple related article on Tom's.[/citation]

100% of Apple advertising - I never said I believed it all. Your failure to read, I told you that if it was factually incorrect, Microsoft should have objected to it. Since they didn't, and since advertising agencies require a certain level of proof before allowing claims, you still haven't proved that their adverts saying their devices work more reliably or with less viruses are not true.

I've never said anything about 'user error' in terms of problems - so dunno where you dreamt that from.

Their products ARE unique - well, that is, until Samsung tried (and failed) to rip the entire product range off. That's why they are the best selling products. I've never mentioned problems 'going away through divine evolution' either. I've also never claimed everything they make is the best, or compares. I simply stated that the iPhone 4S and iPad are the best devices in their genres at the moment. I stand by that. The sales figures stand by me too.

And it's not a mistake if you're man enough to correct it, something you've never been able to do despite the countless misunderstandings you made.

And not that it matters if I hadn't, but I have posted on other articles. As I said though, it's completely irrelevant whether I have or haven't - guess what, people are allowed to have specific interests.

[citation][nom]back_by_demand[/nom]Apparently it's not subjective to Judge Andreas Voss, he just allowed Motorola to have an injunction if it wanted one. Decision has been made.Yeah admiting you were in infrigement is a big no-no, never goes down well in a case that is about infringement....I think Apple needs a new lawyer, the trick here is to flat-out dent any wrongdoing even in the fact of overwhelming and incontavertible evidence. Maybe Watcha should Apply to be an Apple lawyer, he's good at that sort of thing.[/citation]

Decision has not been made, it's been made PENDING APPEAL. Which we've been over, in this very thread, a lot. Lack of basic intelligence surfacing here. Try reading.

Admitting past infringement is justifiable in certain circumstances, hence the whole topic of this discussion (the FRAND DEFENCE) - keyword, defence.. We've actually been discussing the level of proof required to satisfy that defence. All of that, completely over your ridiculously retarded head, of course.

I actually do have a degree in law, not that it's relevant since basic logic is what escapes you. Essentially Motorola is trying to set a new precedent in refusing to grant a FRAND license due to a claimed infringement. Apple is claiming that a) their infringement was due to unreasonable license terms, b) Even that past infringement should not mean that a FRAND patent is granted (read up on what a FRAND patent is to see why that makes sense and that c) The above-FRAND charges that Motorola are trying to claim (I believe 2.5% of the selling price) is ridiculous, and they want to protect their right to challenge that. This will go to appeal and even if that appeal is lost Motorola could well find itself in a tough battle with the EU over mis-use of FRAND patents

[citation][nom]back_by_demand[/nom]I'm glad i'm not the only one who see's through this ass-clown, here is an individual who has been a member 2 year longer than I have and yet amazingly has 5 time less posts, but if you look where he has posted (as you rightly spotted, only in Apple articles) he bangs out at least a dozen posts ranting on like he has copy/pasted "War & Peace" into it....Crank, I would advise just to ignore but it is so much more fun just to annoy him[/citation]

Yes, the number of posts I've made and the time I've been a member is really a good way to discredit someone....

It's only the die-hard anti-apple tools like you that end up being educated, and of course you don't like it, hence the bitter recollection above from Beayn, recollecting the same types of discussion that I've educated you with over the past however long.

I absolutely love that you go to the trouble of finding out when I joined and how many posts I've made given that any attempt to discuss what I actually wrote has clearly been an epic fail on your part. It of course, also demonstrates the tears.

;-)

[citation][nom]house70[/nom]@irish_adam: dude, your logic is as effective as it is correct, you got +1000 here. And good job for pointing out the invented arguments there; he just turned into a condescending little pr1ck when he realized his logic does not stand. FYI, you argued with the greatest apple troll on this forum, as other users here pointed that out. Funny how he claimed he doesn't make mistakes, then he quotes the wrong bit...this was fun to read, but for your sanity, try to ignore trolls like this. They'll never see the reasoning of others, unless it leads to the same result as their own.[/citation]

Every 'invented' argument he claims I made is actually exactly as applicable to his points as they are to mine. The difference is, I predicated mine with 'Apple claims' - he didn't. So his own 'invented arguments' argument actually proves my point.

I am simply putting forward the case Apple did. The Apple lawyers, who know far more than he does, and far more than I do, and reached the conclusions I am explaining.

The bottom line here is that Motorola is trying to have devices banned over FRAND patents, despite Apple being prepared to pay the FRAND license, both going back and going forward. They could very well get in trouble for this, just like Samsung did. Their logic is that they are entitled to do this based on the prior infringements. Apples logic is that the offer proposed by Motorola which caused the infringement (as Apple had to refuse it), was unreasonable. They also claim that the non-FRAND demands of Motorola are still unreasonable, even for past infringements.

There's a reason there is a legal case, and there's a reason Apple are appealing. There are two sides to this discussion, and it is very far from being concluded at this stage. Whatever the verdict, what I stated about Apples claims will remain true.

[citation][nom]back_by_demand[/nom]Apparently it's not subjective to Judge Andreas Voss, he just allowed Motorola to have an injunction if it wanted one. Decision has been made..[/citation]

But in the eleventh hour Apple managed to convince the appeals court to lift the ban. DPA reporter Christoph Dernbach was the first to report the news, taking to Twitter. Apple in statement commented, "All iPad and iPhone models will be back on sale through Apple's online store in Germany shortly. Apple appealed this ruling because Motorola repeatedly refuses to license this patent to Apple on reasonable terms, despite having declared it an industry standard patent seven years ago."

Oopsie, epic fail from you again? Surely not.

hahah watcha, you're so full of yourself. You LOST that argument we had way back about the iphone 4 antenna. I've read back_by_demand's posts and he is also an intelligent and reasonable person (like me), who no doubt, you have lost every single argument to as well.

You have a degree in Law? HAHAH Fail. Do you tell that to all your co-workers at McDonald's? You know, taking 1 class in community college doesn't equate to a degree in Law.

You were so desperately grasping at straws that you did indeed claim that all advertising is true or companies would sue while failing to realize that sometimes it's worse for PR if you sue a company for false advertising.

Then there are the times you failed to understand or completely distorted technology, basic physics, economics, programming, tech history, and a host of others all in a desperate attempt to defend your beloved and infallible Apple products. You've got 3 people here who replied all saying you're the biggest Apple troll on here. Just admit it. You're a fanboi who owns every single Apple product of the last 5 years or more with nothing better to do but attack anyone who has an opinion that isn't yours.

I'm amazed you STILL don't know why you lost the argument about the iPhone 4 antenna.

I claimed, consistently, from day one, that the issue which was showing a low signal bar, and causing the calls to cut out, CAN be caused by software. IT STILL CAN, and I even explained to you that this will STILL BE TRUE, whether or not it actually turns out to be hardware in this case.

Your failure to grasp what was actually being said is the root of the problem, nothing more nothing less.

LOL @ you describing yourself as intelligent and reasonable?

LOL @ trying to insult me by claiming I work at McDonalds, adorable.

Actually, I didn't say advertising is always true. I said that if Microsoft believes it isn't true (a claim made about them) - it's their OWN choice and therefore their OWN FAILING if they choose not to object to it. Either way, it's down to them so blame them.

Listing a series of categories in which we've had discussions and you have failed to grasp what is being said does not make any relevant point whatsoever. I may aswell say 'I beat you at Racing, football, and cheese making.' - yes your argument was as effective as that (laughable, no?)

All the people who cried about me being an 'Apple troll' are those who I took the time to educate on matters concerning Apple. No big shocker, they are all anti-Apple too. Of course, biased apple haters will hate a rational, objective, logical person educating them.

;-)

Oh and the first Apple device I ever owned is an iPhone 4S.

So, please, stop trying to invent a reality for me which would give you any kind of satisfaction ;-)

I love that my arguments destroy you so completely you are in complete denial about my degree, my job, and which devices I own. 'I reject your reality and substitute my own' ...

LOL.

Oh and ... 'just one more thing'...

if you believe a company is falsely advertising - you can report them to advertising standards on your own, you don't even have to be Microsoft to do it.

See, you still won't admit you lost the argument. Why didn't you just quote what I said and pretend you said it instead of just changing the wording? Saying "I know you are but what am I" over and over is just laughable.

You're so full of yourself that you even told irish dude that you "never make mistakes". A sign of a truly conceited and self diluted personality. You "educated" them? I've heard that before, from fanatical Christians desperately trying to argue with an atheist about evolution. (Tons of videos on Youtube about that) Your words mirror those same irrational, subjective, and illogical arguments. It's no surprise, since Apple fanboy culture is often likened to religion.

You remind me of NephilimFree, a fanatical new earth creationist who believes the earth is the center of the universe. This video could very easily be about you.

[citation][nom]watcha[/nom]Oh, and I'm still waiting for your proof that the Apple adverts advertising was false.. 🙂[/citation]

Already proven. "All Windows PCs get viruses". Mine doesn't, my laptop doesn't, my server doesn't. My wife's doesn't. My mother's doesn't. That's 5, and is proof enough. I gave you this proof before, not surprised you "forgot" it.

By the way, making multiple accounts to back yourself up = funny shit. testerguy3 made his first post on this thread, sounds just like you and gave your posts thumbs up! hahahahaha

Sorry, can you link me to that advert, and tell me when and where it aired?

And can you prove that all 5 of your pc's don't have viruses?

Good luck doing that since even the best anti-virus programs or industry experts can't.

And please, just because someone else disagrees with you doesn't mean its me, maybe we have simply found another person who actually has a brain?

Sorry, what are you talking about? My whole point was that you just listing a set of categories is completely irrelevant. I proved that by posting an equally irrelevant list of categories. Do you get it yet? So so dumb... lol

[citation][nom]beayn[/nom]You're so full of yourself that you even told irish dude that you "never make mistakes". A sign of a truly conceited and self diluted personality.[/citation]

Or perhaps someone with intelligence who knows it. I guess with your lack of intelligence it's inconceivable that someone can be accurate..... that explains a lot actually.

[citation][nom]beayn[/nom]You "educated" them? I've heard that before, from fanatical Christians desperately trying to argue with an atheist about evolution. (Tons of videos on Youtube about that) [/citation]

Sorry dude, you just used the word 'You' which I've heard Christians say before. Those fanatical ones, who desperately try to argue with atheists about evolution - go to Youtube and check it out.....

/ end idiocy ..... see just because dumb people say things, for example, you, doesn't mean that anyone who says those things is equally dumb. Complete, illogical, failure, once again, from you. Par for the course, tbh. Your new low is claiming that anyone who claims to have educated anyone is comparable to fanatical Christians. I honestly thought you couldn't exceed your previously record high levels of irrelevance or stupidity.

[citation][nom]beayn[/nom]

Ironic really that this massive rant basically boils down to you saying 'you're wrong' without addressing any of the subject matter you actually claim I'm wrong about, with logical sensible arguments.

Comparing me to someone not in any way associated with me is borderline skitzo, tbh, it's the most lame way anyone could ever use in an attempt disprove anything I say.

I stand by all of my RELEVANT and well constructed arguments, feeling no need to accuse you of working at McDonalds, quite content that my logic stands for itself, and also happy that one day this education you are receiving may sink in.

🙂

Oh, and it is STILL correct what I originally claimed that the signal issue could have been caused by software.

And it always will be true, which is why you will always be wrong in disagreeing.

By that logic, can you prove the advertising that "Mac's don't get viruses" to be true if even the best anti-virus programs or industry experts can't? So your Apple advertising is false? Surprise!

Here's one ad in question that claims all PCs have viruses and Macs don't. Plain and simple false advertising, and proof that you believe everything that Apple spews.

Have you gone to watch the NephilimFree video? The first few minutes talking about ol' Nephy are a perfect description of you.

Why don't I address the things we argue about? Because they have all been addressed a thousand times over. You are too stupid to get it and there is no point in addressing the issues beyond the basics. If we get technical, you just claim you know everything and everyone else is wrong and stupid.

Now you're a psychology expert as well! So you're a computer engineer, with a degree in Law, and an expert in marketing, advertising, programming, psychology and flipping burgers...
I'm 100% on target comparing you to a religious fanatic. You're just too religiously fanatical to understand.

You have never had a relevant or well constructed argument on Tom's to my knowledge. Everything you say is just spewing garbage. You change your arguments and make up facts to desperately defend yourself. It makes for great entertainment though! I can post short messages and you post massive walls of text filled with desperate drivel.
