[citation][nom]theshonen8899[/nom]Sony is not forcing users to sign away right to defend themselves, only that they have to do so with traditional first party lawsuits. Class action lawsuits allow the members of the class to divide the cost of the lawsuit amongst themselves making it cost nearly nothing in exchange for possibilities of enormous gains. What ends up happening is that anyone can jump in on the Sony lawsuit and pay nearly nothing to contribute while Sony has to pay their legal fees all by themselves. Class action lawsuits are still a phenomenon in America and are rarely adopted in other parts of the world. With this change in the ToS you can still defend yourself in case of fraud, however you will need to back the legal fees yourself. This ensures that you truly believe you were wronged and that you can win the case, instead of just jumping on a bandwagon for free money.[/citation]

suing someone like sony could cost up to 30000$ a month, if not more. sony can handle that kind of a loss and will drag it out, in which you will lose most if not all your money in the first month.

the kind of law suit these would be could take over a year to get to a resolution.

if you spread out the cost of a whole law firm over a few hundred to thousand people, you could easily cover the cost of a long term battle.

recently for us, we found out that our roofing was done, used sub par material (see cardboard) and wasn't what we bought, or allot of other people. the lawsuit cost 100000$ a month if i remember right, and went on for close to a year before there was a conclusion, but it was class action, we got lawyer fee reimbursed, and some money for replacing out roof.

lol... seriously, that doesn't mean anything. There could be a class lawsuit for this anti-class lawsuit policy...

Comon Sony, you are asking for it...

I do agree that people shouldn't sign this, and make a class action lawsuit against these types of paragraphs in ToS... unfortunately from what I've read since yesterday, it seems that the supreme court/ the law is on their side and encourages the cancellation of such "class" lawsuits. Why do you think that is? I think it's corruption. Any company would love to outlaw class action lawsuits, and they are almost there.

Nothing new, AT$T has this same scam tactic in their TOS now. Just another shyster company using the loopholes to accept less responsibility for their mismanagement and faults. Add them to the list.

There is some hope at least in the Arbitration Fairness Act, which if passed, could invalidate a lot of what the Supreme Court just ruled against, giving power back to the people. Let's hope it goes through...
