Well see the reason she is suing is because it really was the manhole's fault. It texted her right before she fell.
 
If the parents do sue, we, the tax payer, should be able to recoup those fees for bringing it to court from the family. Stupidity should not be rewarded.

Agreed. It's so much BS that our tax dollars go to the courts for garbage like this. I hope it gets thrown out and the family loses money on this whole thing.

You are just as much a tard as that girl is.

The town would be responsible IF and ONLY IF the manhole was left open with no workers or cones around. If you have read the article you would have seen that the workers who were working in the manhole turned for a second to get the cones. So they were just starting to work on it when the idiot girl happened to fall in to it.

And it figures that a family with the name 'Longueria' is suing for...nothing. Most illegal immigrants figure that's the way to 'make it' in this country.

Not if the parents, like idiots, give permission to release it. Which they probably did.
 
Some of you are interjecting suppositions, and not the facts at hand. It doesn't matter if she was texting, picking her nose, looking for an address, the manhole is a dark steel gray metal that even when removed unless you are deliberately looking for an open manhole, or just happen to look at the very precise moment, are just not going to notice right away or until it's too late. They opened the manhole and left it unattended, even if it's for a split second, and as you see, what could happen, happened! This is an equal opportunity accident. The workers knew they were going to remove the manhole, while the girl, texting or not had no expectation of an open manhole while walking on the sidewalk.

They should repeal any poop-and-scoop bylaws. That way everybody would be very careful where they step, and accidents like this would be avoided. If works perfectly in Paris for example.
