Both of these cases will get thrown out. Her case will get thrown out because she did break the law. His case will get thrown out because the MPAA and the Theater Association or whatever it is won't show up to testify against her.

My point? NOT ALL LAWS MAKE SENSE. This is not what copyrights were made for. They were made to prevent people from profiting from another person's work.

How about you guys head over to the US copyright Office's website and read up on Fair Use Laws.

The point of many us saying "it's illegal" isn't to say that we believe she is a horrible human being for violating the law. I concur that jail is too much for this girl and the nature of the "crime". In fact, the charges WERE DROPPED as they should have been (in fact, they were dismissed quickly). Our point for saying "it's illegal" is to point out the obvious fact that IF IT WHAT SHE DID WAS ILLEGAL SHE WILL NOT WIN A LAWSUIT irregardless of whether it is right or wrong. It is up to the state legislators or US congress to change the law (unless the law violates the constitution).

I would also like to quote from the full article:
"She has suffered great public ridicule, embarrassment, humiliation, inconvenience, damages to her reputation and other damages," the lawsuit states.

Again, she is dumb. This case will only bring about more public ridicule, embarrassment, humiliation, inconvenience, etc.

This happened last November. No one cares or remembers. Now, several months later this case will make everyone remember. Good job dummy.

At best she can file a malicious prosecution against the police. Afterall, it was them that have responsibility for arrestign her - not the manager (say what you will about the manager, a d/bag in my opinion, they don't have the power to arrest you).
 
I wish she would have taken this to court and not sued for just damages. The MPAA didnt want her arrested since they don't someone to win a case like this that would change the law where you had to prove intent to reproduce the film.

She broke the law? Why should the manager take the hit?
 
Killing the new is the best thing you can do to pass time. Why pirate and sue innocent ppl.

His case was already thrown out and yet still made slanderous remarks, which by US law is illegal. For someone being so specific to insisting the law be charged to the letter, then the manager should have known that and not made such comments.

Her case will not be thrown out on that basis. In the US legal system, if you were convicted for a crime, it cannot be used as a basis for other legal decisions, and unless a retrail has been issued, if your case was thrown out or you won for any reason you are to be treated for all purposes innocent, regardless of your actions. Her case will stand up in court because she was not guilty. The manager did nothing to attempt to stop the crime, yet fully intended on charging. He did nothing in good conscious, as a result of the manager's maliciousness in basically just setting up the scenario in which she could be charged by the full extent of the law resulted in a FELONY charge which in almost any other scenario could and would have been just a "slap on the wrist" to most otherwise law abiding citizens.

The post provided a copy of the lawsuit in a pdf. If you read it, she has every right and every reason to sue. The story is a bit different than leaving out vital details and just saying "McDonalds coffee is too hot, so I'm suing." When you word it that way, yes it sounds rediculous. When you add in all the details, the fact immerges that even if the suing is unsuccessful, it wasn't simply someone saying "omg, I'm gonna sue because this is america and i can sue if you look at me funny."

I for one, hope she gets some monetary compensation, because after reading it, she'll need it to compensate for THE FELONY charge she'll have to deal with on her record for the rest of her life, even though she wasn't convicted. As for her as a person? I think it's stupid that she was oggling some shirtless actor. Just as stupid as when guys materialize women. It's the same thing.
 
I hope she gets nothing.

It really annoys me that people think that they are above the rules or can interpret them in how they see fit.

1) The rules in any cinema that I've ever been to state mobile phones to be turned off, no Audio/Video recording equipment to be used, the face she broke this should be enough to earn her a lifetime ban from that chain of cinemas, plus whatever the MPAA decide they can get away with charging her with.

2)Besides the piracy issues, I find it sooooo annoying when people get texts, have their phones light up etc when you are trying to immerse yourself in a movie.

3)Seriously, get a life, If you have to film people taking their shirt off in a cinema to get your rocks-off, you need to either get out more, or learn how to use the internet.
 
at the start of every movie there's an ad from the MPAA or some other warning about any type of reproduction being illegal. What kind of law system do we have that allows counter-suing for something the girl definitely did wrong.

You are the meat head because you don't know what the word illegal means. It means it is not lawful whether you like the law or not, meat head.
 
Just because someone throws some text on a screen doesn't mean you can harass and drag a girl to jail because she filmed a movie she had no intention of doing anything with other than beating off to it. This a cloud laws protecting against pirates and as soon as the MPAA told them to back off he should have! He is a horrible person trying to give a girl a felony ruining her life over $500. What a piece of crap! I hope he loses his job and she gets money for it.

I cannot agree more; this should be the real headline: "Horny Nitwit Ruins Movie For Entire Audience."

How hard is it to just go to a movie, sit down, shut up, and watch?
