If you sign up for something you should read ALL of it, it usually says they will send you messages (e-mail, mail, texts) and that you agree to receive them by signing up. It's not really spam if you say yes go ahead and send it.

I hope the Judge laughs her case out. There is no way 3 text messages can amount to 5 million dollars. Oh and Sometimes being the King has it's privileges.

I hate law suites almost more than I hate Apple. But I kind of want to side with her on this one (although I don't buy her shit about being harmed). I'm of the opinion that cell phones ought to be off limits for spammers and solicitors. Granted she probably was a dumb ass and signed up for some promotion. But still, I'm sure we have all received spam texts that we definitely did not subscribe too. Sure you can say that its only 10 cents, but that's still money. Spam is bad enough already with out us having to PAY for the honor of being annoyed, no matter how small the fee. In the end though, I would rather see this issue resolved through legislation rather than frivolous law suites that only benefit a few greedy lazy sacks of welfare shit.

By the way enyceckk101, 5 million dollars does not equal 500 million whoppers. I usually don't like to harp on peoples math mistakes, but you really shouldn't screw up a simple 1 : 1 conversion ratio (then again I guess whoppers are 2 dollars or something, but whatever).

No one wants SPAM and when you sign up for a promotion, there almost Never is any box to Opt Out of such SPAM.

Also, such wording allowing them and their associates to send you SPAM are almost always hidden in the user agreement. They deliberately make them long and difficult to read so most people won't bother to read the agreement.

At the very least, maybe a lawsuit such as this could force a change in the law to mandate an Opt Out box be included on all such promotions.

I just realized! We were all so caught up in how much of a dumb ass this woman is, we all forgot to ask why the hell Tom's is giving us an article on a woman suing for spam. Honestly, this story's irrelevance reminds me of the "Technology" news reported by Tom's in which the Chinese prostitute was beaten by the police. I think the link to technology in that article was a camera or something stupid.

I think this is more of a Class Action Lawsuit were there are multiple parties involved. More people = bigger pot of gold and more you have to share. Even though she started it, they are probably look at other people.

While technically I agree with you, having an agreement to receive advertising buried in a promotion or something else is, IMHO, an extremely subversive way of getting information to spam you.

IMHO, all such buried subscriptions should be put in plain sight on all offers that include them, and there also should be a way of opting out.

With e-mail, there are services like www.sneakemail.com that, essentially, make you immune to "spam attacks." Not being a cell phone owner, I have no idea whether the equivalent is available for text messages, but there's a business opportunity for someone. :)
