That's probably the smartest thing anyone has said in here yet. Other than the fact that this lawsuit is dumb. Although, the LEGO condoms makes sense...
 
There seems to be some confusion as to the purpose of trademarks and the laws surrounding them.... A trademark is meant to protect the consumer. There cannot be two companies that make timepieces named Rolex or even a competitor named Rollex. They are meant to protect consumers from buying goods or services from one company and have it be another. Trademarks are NOT to protect the companies. Likely the reason that this lawsuit is even proceeding is that if someone has a trademark that is being infringed and does not show a reasonable effort to protect it then said trademark can be revoked. This is definitely a reasonable effort to protect their name which leaves no room for a potential revokation of their name to occur as a result of this. This is along the same lines as Best Buy suing a Catholic Priest for his "God Squad" car.
 
I'm dead certain the lawsuit arriving on the Xoom tablet breakout week, which establishes the new product, was fully intentional... That is, if you are going for the throat in a lawsuit. Read: BIG $$$ instead of a pesky name change hassle.
 
Unfair competition? Motorola transfers money and Xoom.com produces and sells tablets???

Well, I guess there should be a law that all products should get automatically generated trademarks and natural language words should not be allowed to be used in commerce.
 
I got confused when I heard the xoom tablet news at first. I knew about this service, used it for a while. its an easy way to send cash over seas, and its relatively cheap. that being told I was wondering when this was to come out. the service is actually advertised alot on philippino channels in the US, first heard of them about 4 years back.

I can see this as a real problem for Xoom (company) since motorla baught up the key word from search providers, at the same time it is glaring evidance that motorola is taking traffic directly away from xoom financial.

Personaly i would make it a policy to make sure your not using the same name as someone else. Honestly did these people forget about google for the last 7 years? the sight is RIGHT THERE! its the first link, not even a change in the web address, in fact type in www.xoom.com gets you there.

Motorola deserves what ever it has comming for releasing such a high profile product without doing the 5 minuts of reasurch to make sure the name is good.
 
I use the Xoom service to do money transfers to my wife's family in the Philippines. I have been seeing the ads for this device which I wish I could afford to buy and never once thought about the Xoom service I use for wire transfers. As far as the search engine comments about people confusion the two items I am thinking if you put in google "xoom wire transfer it pops up". Just my 2 cents.
 
Motorola is a big company. Why didn't it research if a name is already being used by a company or already trademarked before using it? Someone's oops is another's gotcha.
