Asus notebook Remove the HDD and pre installed OS

I got a laptop that was supposed to come with an 128 ssd with the OS installed in it. Surprise surprise! The store i bought it from removed the ssd and let the 1TB (5.4k rpm) in, and made a partition where the OS is installed.
Can i destroy the hdd and get a 500 GB samsung ssd and buy a w10 OS¿
I'm scared because i read that the pre installed windows is attached to the hardware so you cant wipe the OS or stuff like that.
¿Should i get the SSD and try cloning it to it 1st?
This post was motivated because when open the management tab i see the hdd staying at 99 100% without doing anything (i just got the laptop and i'm trying to update to w10) I will never buy a single product from this store again.

If i do that, would it be equivalent to buying a laptop without windows preinstaled?
 


The disk usage algo goes 100% continously
