When I was sold the Cingular Warranty,
their representative, at the Cingular Authorized Dealer,
never said that I was buying a warranty that would
replace my original cellphone, with a "reconditioned"
cellphone.

It was explained in the paperwork- at no point does it say that it was
verbally explained. Give it up- they did exactly what their warranty says
they can do, and it is a common practice in the cellular industry. You did
not send them a new phone- they did not send you a new phone. Even swap.

Very few warranties for "ANYTHING" that replace items over 30 days old
with anything but refurbished/reconditioned. You bring your Chevrolet in
for warranty work you expect a new car?

No, but I do drive off with the same Toyota Corolla I purchased,
in 1999.

First off, you did not BUY a warranty, the phone comes with a warranty from
the manufacturer. If you paid for something it may be insurance which is a
totally different animal. If you still have your owners manual check the
warranty specs. SonyEricsson swaps phones, most others state thay will
repair or replace at their option. If you decide to send your phone to the
manufacturer, it will be gone for a week or more and you have no phone in
the meantime. What Cingular offers you is a warranty exchange. As long as
your phone is less than 12 months old, they will send you the replacement
first and you return yours back. Look up the word exchange in the
dictionary. It means we give you something, you give us something back. If
you want the real manufacturers warranty, send the phone to them. Then your
gripe would be with the manufacturer instead of Cingular.

Repair the phone and return my phone, don't give me a "reconditioned" phone.
I didn't buy that one.

Which might well be very bad news indeed. Better to get a factory refurbished
car, but that's unfortunately not an option.

Cingular replacement Motorola Model V400 GSM cellphone.

Cingular Logo on the top left hand corner.
"Warranty Exchange or Wireless Phone Insurance Transactions"
The following terms and conditions apply for either a Warranty Exchange
from transaction or a Wirless Phone Insurance Transaction.
Please see the correspondence that applies to your requested transaction.

WARRANTY EXCHANGE
The following are the Terms and Conditions for your Warranty Exchange
transaction:
Enclosed is a preaddressed return mail package along with your replacement
phone.
This package is to be u sed to return your malfunctioning phone.
If the phone is not received by Cingular within 14 days,
a processing fee will be charged to the account.

1. As you were advised, by initiating this replacement phone exchange for
your malfunctioning phone, you agree that the phone is not out of warranty
(i.e., liquid damaged, physically damaged, or otherwise out of warranty).

2. If it is determined the phone is liquid damaged, suffers from excessive
wear,
or tear or is otherwise out of warranty, by returning your defective phone,
you agree to pay a processing fee.

3. Cingular is unable to return your original phone after the phone is
exchanged.

If you are not enrolled in the Wirless Phone Insurance Program,
the following section does not apply.

WIRELESS PHONE INSURANCE
The following are the Terms and Conditions for your Wireless Phone Insurance
transaction:

Enclosed is a preaddressed return mail package along with your replacement
phone.
This package is to be u sed to return your malfunctioning phone.


1. As you were advised, by requesting this
replacement under the insurance program,
this transaction is final.
It cannot be reversed or cancelled for any reason.

2. A $50 non-refundable deductible will be charged to your account.

3. If your phone is lost or stolen, the requirement to return your phone
is waived. If you find your lost phone, please return it by using the
enclosed preaddressed return mail package.

Wireless Phone Insurance for customers of
Cingular Wirless is underwritten by Continental Casualty
Company, a CNA Company (CNA) and administered by
lock/line, LLC.lock/line, LLC is a licensed agent of CNA.

Any person who knowingly and with intent to injure, defraud, or deceive,
any insurer, files a statement of claim or an application containing any
false,
incomplete, or misleading information is guilty of insurance fraud.
In Florida, such conduct is a felony of the third degree.

Contact lock/line at l-188-562-8662 with any questions you may
have regarding this request for replacement.

PREVENTIVE CARE AND MAINTENANCE TO AVOID FUTURE REPAIRS.

We have a few preventive care and maintence tips to help avoid repair and
replacement costs, ensure warranty compliance and extend the life cycle
of your wireless equipment.

Keep the unit dry. Liquid damage causes the electronic components to
corrode. Avoid storing the unit in dusty areas. Avoid extremely hot and cold
areas.
Do not open the unit. Avoid dropping the unit. Internal circuit boards can
break.
Do not use accessories that are not functioning properly.

You may be subject to a return processing fee or an insurance deductible.
For the Warranty Exchange process, these fees do not include premium
shippping charges for your replacement unit.

I bought a brand new phone from Cingular,
and when it was defective, it wasn't repaired and
returned to me.
I now have a phone I didn't buy, it's not really mine,
somebody else was using it, it's 2nd hand.

I expected my original phone, that I purchased, repaired.
Not a 2nd hand phone, that Idid not purchase and somebody else used.

I don't know why I'm bothering but here goes...

You are truly an ass that is bitching just to bitch. If they had fixed your
phone and sent it back to you not only would you still be getting back a
REFURBISHED phone but it would have taken days if not weeks longer to get
the same phone back. You can go on and on about not having "your" phone
returned to you but either way it's refurbished.

You have no proof that the phone was used by someone else. It's very
possible that the phone was defective out of the box and was sent in for
repair and used as a warranty replacement. I just returned a Motorola V551
that had a flaky #4 button it was never used.
