Yes, they should. They mantain piracy is theft (implying it's a criminal offense) after all, and this guy actually has the millions to reimburse the 'lost revenues'.
Whatever he makes from this movie would be a start (it'd cover the legal fees, perhaps) and then they can garnish his earnings for the rest of his life.
