GameStop Sued Over Misleading Used Game Sales

Gamestop has a club card. It costs $15 a year and comes with a subscription to Game Informer. With the card you get an additional 10% discount on used games. Essentially you get 20% off recently released games and more on older games. 20% is reasonable, the magazine is worth $15. Anyone who frequents Gamestop should know this. Perhaps they should provide an advisory about DLC, but their prices are more reasonable in a a supply/demand sense. Everyone simply wants more for less...

i remeber a comercial for left 4 dead 2 sightign if you PREORDER you get a fre base ball bat dlc .... this ws for pc or console version... yet odlly i bought the game months later on steam and the bat was alredy in game it seems and every one i kn ow that didnt preorder stil had the bat ... bassically game stop was lyign trying to make preorders caliming the bat deal was a preoorder exclusive with them,

That free DLC is a rip off? When you buy it used, NONE of that money goes to the developers. So why should they give you free bonus content? Ridiculous.

Next you'll say that free preorder bonuses are a rip off, because you don't get them when you buy the game used.

Wow. Is a trial even necessary when we have this persuasive jewel of a comment? Since we're all throwing in our completely baseless opinions as to the merits of the case, then so will I.

Dismissed? No. And unless the same captains of industry that shot down the idea of 5-cent "No-DLC Included!" stickers to slap on each one of these wants to roll the dice on the outcome, this will be settled.

Many of the commenters here would be included in the class (because of a past purchase, not quality of comment). What will Gamestop have to offer to make good with you?
 
gamestop also sells used games as new. the games they open and use in the store they will then sell as a new game even though the box is opened and the disc has been put in a system. this to me is even more outrageous and they should be sued for that. especially when you call to see if they have a game and they tell you they have one copy left and then when you arrive there you find that the one "new" copy they have left is actually used. F gamestop

What don't you get about it being a "used" product? There are no guarantees or warranties made by the reseller of used games, other than those given on the receipt, i.e. that the game will work. It is sold "used" for a reason. If you are stupid enough to believe, without any representation made by Gamestop, that for a savings of $5 that you are getting the same product as that which is new, your sir are an idiot. Are you going to hold every ebay seller of used games to the same standard? I suppose you'd also want to sue them if every used game didn't come with the 48 hour trial of XBL Gold that typically comes with each game.

Just because you do not like Gamestop and the fact that they have questionable business practices on OTHER issues does not increase the viability of THIS lawsuit.

When you are caught stealing a CD from Target, do you get fined $15??? No, the fine is much larger and might include jail time. This is a similar situation. If the punishment is a lot more then the value of the game, maybe Gamestop will learn a lesson. A man can dream, can't he?
 
Gamestop has always seemed unreasonable to me. I just have an old XBox and the want $17 for used games that are any good. Then they told me almost a year ago that they were not going to sell them anymore because the old Xbox games were not selling well. Well, how about lowering the prices of good used games to $7-$10, then we'd buy a lot more; but no, they were still at $17. I tried to sell some used Xbox games, and they'd only give me about $1 or 50 cents for each one for credit. It seems reasonable to expect to trade in 3 or 4 games to have enough credit to get another used game, but with their pricing I'd have to give them about 15 games to get enough credit for 1 game. I use ebay instead now. I hope Gamestop gets what they deserve.
 
Another thing I don't like about Gamestop is that they take the discs/media out of the packaging for NEW games. So, how do you even know if you're buying new? Needless to say, I will never buy from Gamestop again.

As for used games, I have been buying solely from ebay. I typically get new releases for about 1/2 the original price.

Gamestop, though, on used prices is awful. Many times, their older used title prices are HIGHER than a NEW copy online. A case in point is platinum hits for the Xbox360.
 
I think they should sue the stupid publishers not gamestop, this could happen to anyone innocently trying to sell their old games!

Gamestop is in the business of selling used games. If you want to argue otherwise, "esquire", have at it... I'm curious what you come up with. There are thousands of people who have purchased used games from them that fall in this category... unlike an "eBay" seller.

Any Gamestop employee will wrongly tell you the used games are identical to the new ones. And both boxes advertise the DLC, with no disclaimers. So they're selling identical things side-by-side... new $60, used $55. Easy choice, right? Until they tell you that you'll miss out on something you'll have to pay $15 for later. If every customer knew that, Gamestop would probably have to drop the price of the used ones.

Gamestop will argue they have no reason to "trick" someone into buying the cheaper game since they lose revenue. That's a good argument, until you find out their profit margin is so much higher on the used one.

As for the XBox Live membership... is that advertised on the box? No? Then it's not even the same thing, so why do you even mention it?

And stop calling people "stupid" and "idiot" without showing why. About a month from now, if you start seeing "No DLC" stickers on the used games, you'll know who the idiot is.


 
I can't believe how uninformed some consumers are. I can only imagine that people don't understand where their money goes after the purchase, since it's too tragic to think that someone would rather save $5 buying used, than support the game developers buying new.
 
I miss the days when GameStapo didn't own EBgames, Software ETC., and Funcoland. Bring back the competition! (I remember when the local Funcoland still carried used Super Nintendo systems and games for cheap…even though the current gen at the time was PS2/GC/Xbox)
 
Hey they just did the same thing to be with Battle Field Bad Company 2!!! WTF!!! Bought the limited edition used with the VIP codes and was not notified that I would not get get the password, when I tried to return it I was told oh-well. How can I get on this train to sue? These guys need to be put out of business they rip people off everyday. Selling scratched used games and giving a rip off trade in value. Example: Got the new madden 2010 for my bday in september. Game was only a month old and sucked. They wanted to give me $17 for it and turn around to sell it for 54.99 used. Can this be stopped? BOYCOTT Game-Stop I will stop shopping there.
