Okay, you as a company have a decision, pay $8000 per year to license a patent that was granted, or spend years and millions of dollars to fight it.
You pick.
The problem is that in order to defend against stupid patents, you have to have stupid patents. You must have a lot of patents in order to throw back in the faces of idiot companies trying to abuse the patent system.
Right now Google is wising up to this racket. For the longest time they did not file off tons of idiot patents, and have been getting hammered left and right for that. Some companies have tens of thousands of patents and are swinging it like a giant hammer on their rivals. Hell, Apple got Samsung banned from import in the EU on touchy feely patents.
The only solution is to make Software process patents invalid, and revise the other patent systems. Put Penalties for abuse of the patent system. Restrict how many patents you can apply for on the same thing (companies fire off dozens of patents on the same things in a soft of Sphaghetti to the wall approach). Turn these billions of dollars in legal weapons to dust and see patent trolls like Lodsys and Intelectual ventures into paupers they should be.
