HP TC4400 Pen Pressure Sensitivity Problem (pen itself?)

So I just just recently got a tc4400 tablet pc with a wacom display but I've been banging my head against a desk trying to fix the pen pressure sensitivity, until recently I found out that when I use the pen tool in PTS on the eraser of the pen the pressure sensitivity works to my surprise. When I try to use the pen normally its always on max pressure. So what I'm wondering is if buying a new pen will fix the pressure sensitivity. This past week I've been dealing with drivers and stuff, switching operating systems, etc. Any advice is greatly appreciated.

Due to the "interest" in the post, I went along and decided to buy a new pen (model PL800A) and my assumptions were correct . The pen was faulty. I hope to anyone that comes across this issue can find this thread and not bash their head against the table like I did.
