lost sd card and wanting to put pictures from an old phone to a new one

Recently, my sister has got a hold of her old photos into her new phone but her old phone was formatted and was taken back to the store. She can only "comment" on her pictures but not delete them. She has some of my pictures but not all. Can she retrieve all of my pictures ? She only has few of mine and a lot of hers. I really don't want her to have my pictures but she only received a few, can she get more or not? It was a system back up, I think but her new phone isn't the same as her old one.

Yes, she can access all of the pictures if she tries. The phone could be connected to a computer and all of the files accessed (and even copied) to the PC.
