I wondered how long it would be before something like this happened. This guy might well have gotten away with it too, if it weren't for (no, not the meddling kids) but his big mouth (you'd be surprised how many criminals are caught this way).

This is why I do not like contraband laws (i.e. you can be jailed just for having something regardless of motive, intent or how it got there).

Make possession of child porn a minor offense (only requiring a fine). Make possession of child porn by a registered sex offender a felon. Make distribution of child porn a misdemeanor. Make PRODUCTION of child porn an automatic life sentence with no possibility of parole.

Scary how easily that guy could've gotten away with it. I don't know if police in the U.S. would go that extra mile to make sure a suspect is guilty or not. His reputation is still probably ruined forever.

No, they wouldn't. The job of the police and the DA's office is to collect evidence of a crime and prosecute it, not to actually discover the truth. If you want that, you have to spend huge amounts of your own money and hope the jury believes your expert. In these cases, however, most people on the jury are ready to castrate you without a trial. Think about all of the people that you see in the news that are arrested for possession of child porn. Now, how many of those are innocent people whose computer's were infected with malware and used as a server without their knowledge. Police and DA's are afraid of that becoming a common defense, so they downplay the likelihood of that happening and claim that they can rule that out definitely. But most of us on TH know better. Some of that malware is EXTREMELY sophisticated and easily capable of defeating AV software and going completely undetected.

It's scary how close this came to working... or maybe he really did have child porn on his machine and this was a successful "I didn't do it."

Either way its better to er on the safe side since they can't prove he did do it. Now if they can prove that the guy DID plant this child porn on this other guys machine.... He should be charged with distributing child porn and all the nice goodies that come along with that charge...

The innocent one (which ever one it is) is probably ruined for life. So they should be able to sue the actual offender for huge damages to set an example for anyone else contemplating some set up like this.

The true monsters are his friends and colleagues who were ready to throw him to the dogs. I don`t think I`d want to be friends with these people even after of being cleared of charges.

Or even getting 'cp-rick rolled' and ending up with crap like that in your cache. It why I never ever click tinyurl/pic links, regardless of how much I trust the site the link is on.

Weiner anonymously sent police a CD containing 177 indecent images of children, claiming that the files were taken from Thompson's laptop. The police took the bait and confiscated the device

So all I have to do is anonymously send a CD and a phone directory and nobody in London will have a Laptop for a few months.

Yeah i think " Innocent until proven guilty" doesnt mean much when your guilty of a crime just by having bits of information on your machine. The fact that they dont have to prove it was you that put it there in this day and age of cyber attacks and nasty malware is pretty bad.

Waiting for the day when malware puts CP on your computer then notifies the police with your information.

Is it better to jail an innocent man or let a guilty man walk free?

Better yet send a CD with auto play some sort of web page content with all those nasty pics to the police then call some sort of higher ups and tell them the other ones have child porn on the machines and that its stored in the browser cache... of course they would hunt you down to the ends of the earth and probably do things to you... bad bad things.... lol

I'd much rather the guilty walked free. What's worse, getting robbed and the criminal getting away or getting falsely convicted of robbing somebody?

Certainly seems reasonable, but one might argue that if you lessen the penalties for possession, then you would potentially increase the demand, and/or the likelihood of inducing additional people to seek it out that might not have with harsher penalties.

Of course, if you're the sort of derelict that's after kiddie pr0n, you're probably going to find it no matter the penalty. Gross.

haha yah, i bet you wouldn't see any news or info if the police department was loaded with child porn.
