Facebook is soon to become a publically traded company. Facebook makes money off of it's users by giving them a social portal and in return selling them out to advertisement companies. The fact that they make money, and even more so when they become publically traded, makes them accountable for consumer protection litigation. When it comes down to consumer protection, in many states they 'are' required to provide services to legitimate customers without discrimination. Denying an account to this guy is discrimination based on name. If the lawyer decided to sue, he would in fact have a pretty solid case.
