I have studied law and the application of law. If you would like to take exception to my post, please do so with some supporting argument that would indicate your position.

From my personal experience, I received a spam picture that contained very offensive child pornography. I contacted the FBI's office for exploited or missing children and reported it. They hunted down the sender. They did not arrest me. If in the course of some other issue, this image had been found on my hard drive, I would have been investigated and possibly arrested. All of this according to the field agent I spoke to.

Again, if you have a real argument, please present instead of just tossing an insult like some sullen child.

Some of these "child porn" laws are rather asinine. In the state I live in(Georgia), the age of consent is 16. So, if two 16 year old people engage in sex, then they are not violating the law. Oh wait, we do have laws against adultery and fornication(well, that law was actually struck down about six years ago). Of course, if these same two people take nude pictures of each other, they have now committed a crime.

If this is not the biggest pile of bullshit I have ever seen...how are people supposed to understand the law when it is so ridiculous. How can pictures of a nude 16 year old be more harmful than the 16 year old engaging in sexual acts? Do not get me wrong, I am not for people be able to obtain pictures of videos of people under 18(or over 18, for that fact) engaging in sexual acts. It is just that there are too many consequences these days.

Was it stupid of this person to take a nude photo of themselves? Yes. Did she do it willingly? I am betting that she did. The male student should not have forwarded the picture, but this is the kind of stupid shit that kids do. If we have a 40-something year old being a "peeping tom" and taking nude photos of young girls and boys, then I would be all for sticking it to that person. The fact is that we have stupid kids acting stupidly.

Society should not be shocked when these kinds of things happen, as it is society that has fostered this very environment. Law makers look to punish the very thing that they stand by and watch occur. For the life of me, I do not understand why more people choose to be blind to such things.

You are either lying or utterly stupid...probably both. I will not waste my time discussing just how stupid you are, as I believe most people will figure that out for themselves.

Prosecuters are running amok in this country and too many are on ego trips. My uncle is a defense attorney specializing in cases where people are caught growing marijuana or were carrying it for personal consumption, or are fingered by one of the prosecuter's endless supply of prison snitches. These people are, more often than not, face being charged as if they are drug barons. He will tell you just how much scum prosecutors and police departments (who will use it as an excuse to treat your property as a free shopping mall) have become.

If the prosecutor wants to be creative he can easily charge the kids as grade-A sex offenders. The families will then either have to settle and be registered as a "sex offender." If the defendants do not accept his gracious offer and decide to become "martyrs" (the term prosecutors use for people who dared to exercise their constitutional right) they will claim they have no choice but to seek the maximum possible penalty (often by applying the law in ways the framers never intended).

It is indeed laughable to hear prosecutors say they have "no choice" or "I'm just following the law" when they seek outrageous sentences. It has not been lost of defence community that the same arguement was made by the Nazis on trial after WWII. Hence, that feeble justification has come to be derogatively known as "The Nuremburg Defence."

Even if the family of these kids take the case to court they will have to pay upwards of $100,000 on legal fees. Even if you win the case you can say bye-bye to your college fund.

She sent it to her boyfriend whom she thought she could trust. She was just sharing an intimate moment with someone she was intimate with. She is guilty of being young and trusting. Not her fault for his deceptions.

While I agree in theory, I must say you forgot another option that may upset the apple cart. If I received the picture and deleted it, am I steal guilty just because I didn't report something that I took care of on my own. Likewise the coke, if received the coke and then flush it down the toilet did I not save taxes payers money, time and effort by merely doing so. Do I have to report it now that it doesn't exist anymore?

On a side note...
"Viewing the photograph and forwarding it are technically violations of child pornography statutes, though police and the Will County state's attorney's office say they typically handle such cases through juvenile probation. No one has been charged."

Looks like they are just investigating the incident and there have been no indictments or arrests. In fact, it looks like they normally just keep an eye on the folks involved for a while.

Most jurisdictions I know about, you are required to report knowledge of a crime. Not reporting it can result in being charged as an accomplice at some level.

This story is definitely lacking photo-graphical evidence proving that it even happened. I won't believe a word until I get some solid "visual" evidence har har c'mon tom

Well I see this as he was wrong. You shouldn't send pic of ppl you get. Come on!!! All she did was send a pic to guy she hoped liked her, but because how we raise are kids he didn't see nothing wrong with sending it to his friends. (He should have not betrayed his duty of being a good person, and keeping it to hisself.) This is just a case of the parents fault. They should have them on trial as well for teaching him to be a crappy person, but they will see this as her fault. It's like the days when they say, "it was her fault for wearing the cloths, she must have wanted it." I do hope that it don't turn out to be like this. She just a young adult trying to be an adult, and we as adults lately have not been setting a good example. Maybe before we destroy all that has been given to us, we can learn to be better, or we will not. I know i didn't make a point, but sometimes there is no point to life.

There are some problems with the laws on this. This is not the first time this has happened.

"kids" - even if they are 16, they are still KIDS... do childish things. And that includes taking nude photos of themselves and sending it to friends or BF, etc. A year or so ago, the girl sent nude photos to her BF (both about 14~15 - dont remember). BOTH are charged with child porn and were to be tagged as sex offenders. I don't know how it ended.

The accidentally viewing part is stupid. Because sometimes the fed/police over-react and will toss your butt in jail. So with such heavy handed tactics - many people WON'T report. And since all of these phones belongs to kids, they don't know better.

At this point, the girl has already been punished.

This kind of behavior is a lot less BAD than anything I personally did growing up in the 1960's - 70's.
Try being a drug addict,selling drugs,going to a federal prison,growing up on the streets in NYC and Boston.I can tell you lots more too.
Like remember FREE SEX !!! I do remember screwing lots of girls and going to outdooor rock fests with tons of naked young people.

SEXTING is just a way of pissing off the establishment and your parents.It is the same kind of behavior kids have done since kids were around and it works.Folks sure get pissed off at those who do this.And it is probably a lot safer than binge drinkin,drug taking,and juvenile delinquency.

LOL yeah these 16 year old kids that were 14 years old for Obama's election and 10/6 years old for GW's elections sure did us in! Why oh why do we let minors vote?
