Is that 5% a wild ass guess, or is there some basis for it?

I was just notified that I am part of a class action against HP for failure
to deliver "recovery CDROMs" and using part of my hard drive for recovery,
depriving me of a few megabytes of space.

I can order CDROMs as my settlement.
The plaintiff's attorneys get $2,000,000.00
I would love to be able to opt out and cause those ambulance chasing
parasites to lose out on their cash. They are the only ones who are set to
benefit from this.

Yeah, someone I know recently bought a Compaq and asked me to come over to
make the recovery disks when after a couple days of use, it popped up
prompting him to do so. Damn thing took 10 CDs, and when I looked, each CD
was about a third used. If anything, they should be sued for being idiots.

This one is honestly the first one I've ever seen that said if a certain
number of people opt out, then the matter would be dropped. Toshiba is
pretty smart to get that in there...now they just need to get 5% to take
the action, as by default, no action equals accepting the terms.

Oh, just that document ;-( I hoped that was some universal control on the
class action suit industry. I've been notified that I am a member of
several classes, and in each case, I wish that the extra cost of the class
action wasn't put upon the company, and eventually passed on to me.

Mine won't even make the recovery CD's. If you follow the instructions on
the web page, it leads you to a program that isn't on my HP/Compaq 503W.

A class action suit should really be "opt in". The HP suit was brought by
two people. I don't want to sue. I certainly don't want some bozo law
firm getting $2,000,000.00 for acting on my behalf. The original two
parties get $15,000.00 each, which is also ludicrous for the loss of the
"hidden" space on their disks.

I was once the "beneficiary" of a class action lawsuit. My share was
less than $1 (around 78 cents). The lawyers, and there were more than
2, each received greater than 2 million dollars for their efforts on
my unwilling behalf. Isn't justice wonderful?

I got 63 cents once from a lawsuit against a long-distance company.
Whatever the company might have done, it didn't do it to me. I threw
the check away.

Thaqnks, the main reason is that my older brother has a HP pc from a year or
so ago and didnt get the recovery cd's and didnt think he should have to pay
extra for them.

Apparently, not only did HP charge for them, but they wouldn't even send
them to you unless you told the right story about why you wanted them. If
smoke came out of the disk drive, and your system was down, you could get
them, but if you wanted them on hand in case smoke came out of your disk
drive, they wouldn't send them.

There was also supposed to be a program on the system that would let you
write the CDROMs yourself, one time. Mine didn't have that program. If
your system came with additional software, there was no way to get the CDs
for the additional software.

But it was cheap. I figured that these oddities were part of cutting the
price so low. I got what I paid for. I've had no trouble with it, and
it's over two years old now.

It may be justice, but it doesn't work. The next version will be just as
shoddy, and if they get caught, any fines they pay (be it in the form of an
actual fine, or in the form of shyster fees) will just be a 'cost of
business'.

This is why I like personal liability on the part of corporate leaders
for the actions they take in directing the company. Sometimes money
doesn't make anyone "whole" as you say, maybe getting all their
assests confiscated and sitting in jail for an extended period of time
would make them think twice before deliberately hoodwinking their
customers.
