Shenanigans.
The router will only give out the IP if the previous lease has expired. Windows will request an IP when the lease expires and if it expires while asleep it will request when it wakes up. If the previous IP is in use when this request happens then a different one is issued.
XP also alerts users to a duplicate IP just like Vista/Win7. It's nothing more than a gratuitous ARP that is standard in any TCP/IP stack that I've come across.
This IS a new problem described in the article. DHCP is as old as dirt and not exactly a hard protocol to implement on the client side. Apple has their heads up their butt on this one if they can't even handle a NACK.
