Depends how you read copyright law (and what is in the 'spirit' of the
law). Buying a laserdisc of the movie buys you the rights to play back a
copy of that film - if your copy is damaged, or you are unable to play it,
then you can theoretically purchase a 'backup' copy of the material
without the rights attached. Thus buying a DVD backup of the film is
theoretically legal. The original copy can't be sold on (as the rights
are sold on with it) unless you destroy the backup, and you are only
permitted to play back one copy at a time.
This is how many websites 'get away' with offering archive copies of old
Arcade Games - they make you assert that you're using the downloaded copy
for backup purposes only.
Making any more than out-of-pocket expenses would probably be illegal for
the person doing the copying, though.
This based on UK law - it might be different where you are (and the law is
always open to warped interpretation!).
