Asus Zenbook: Not working from battery, Win 8 says "charging"

My Zenbook UX31A does not boot or work from battery. When plupged in it workes fine. In Windows 8 it says "battery: 39% charging ...."
That never changes, always 39%
When I unplug the AC/DC the notebook goes off in the same second, it is not working from battery, nor booting. It only says "charging"

I can see the battery with special software utilities, everything seems to be ok, just the fact that it says: load 39%: time left 0:39 minutes makes no sense. Time left should be around 1:30 to 1:45 hour at 39%

Any idea what is broken?
Fault battery?
Fault connection?
Motherboard broken?
Or Bios does recognize the battery as a 3th party one and does not want to use it?

It's actually the battery is faulty and needs replacement already. If you still have a factory warranty with it I suggest you have them replace it.
