Is Discount Mountain software a legitimate DOEM

If I purchase Microsoft Office 2010 home & student OEM from Discount Mountain Software, will it qualify for Microsoft's free upgrade to Office 2013? Are they a DOEM?

I highly doubt Discount Mountain Software is legit. OEM software is to be installed as part of the build process by OEMs and not to be sold to individuals.
