It's clear what happened hear, the prosecution filed the case in the wrong district. They needed to find a more corporation-friendly judge. I'm guessing they should have tried Minnesota, where apparently offering one song on Napster is a $167,000 penalty.
 
That's why basing your entire case on obviously illegally obtained evidence isn't the best idea. Now if the kid is feeling froggy he can file countersuit for all kinds of fun stuff like defamation, emotional damages, financial damages, and the like.

counter suit for recording info on his propertywithout his consent, with a suit for defamation of character and recoup of legal expenses imo
