Asus UX501vw recond, screen trouble right out the box (with video) Hardware or software?

Hi guys, just got a great deal on a ux501vw, but right out of the box I ran in to trouble, there is crazy screen "tearing" and odd artifacts when I access the start menu. see video below. There was also the "snow" problem that Ive been unable to recreat.

The tearing doesn't occur all the time, but more often than not.

I updated win, no change, I updated the 960m drivers, no change.

What do you guys think? Should I send it back or is there something else I haven't tried?

Any input will help me, Id rather not go through the hassle of sending it back, but if i have to I have toi, right?

If this is a brand new device and already giving you this trouble I would return it and get another device.
